Your right that we are there to observe and report but if you remember if you see a crime in place you can detain a person in other words handcuff them. he was caught stealing the security guard stopped him and detained him I have detained a few people myself as a security guard you are allowed to detain a person and handcuff them, you have to release them to the police once you detained them but other than that it is 100% legal to stop someone from stealing

I guess being deaf now-a-days gives you the right to steal and be exempt from any form of punishment. God forbid if a deaf man ever breaks into your house - Might as well give him the key to your front door. Besides, there is a very, very big difference between a choke and a strangle - That male is not being choked. Security officers have a very difficult job, and when faced with a situation like this, whilst being surrounded by potential threats, a strangle is quite often the only resort.

We know nothing of this situation, especially any claims that this person is guilty of anything (prior or otherwise). This is all assumption and hearsay at best. Door alarms go off ALL THE TIME without meaning someone is walking out with an unpaid item. Most often it is the staff's fault. I've floorwalked for over 7 years and even I adhere to the adage: Innocent til proven guilty.

@le238man, well not really, the only time its really the end of the line as far as employment goes is when retired police go into the job for extra pennies. the only thing that makes them seem like violent thugs is they aren't allowed handcuffs, mace, battons or anything for self defense. many security guards work in places that act as methodone clinics and needle exchanges, so to do the job with no "tools" is pretty ballsy and its less painfull for every party involved when its from behind ;-)

His reason for resisting arrest is because he was being choked, once he got out of the chokehold he got on his back in a submissive position.

@JoshHooten That's funny, because the guy has a criminal record of thievery, and is in jail as we speak. He is currently being charged with " one count of 2nd-degree robbery and one count of petty theft with priors". The internal investigation has concluded that the alarm (siren AND lights) went off, the guard identified himself to the thief, the thief acknowledged him, and then fled the scene with the stolen goods. When the guard caught him, he resisted arrest. What are your sources?
