Snake made it on because when Melee was being made, the creator practically begged to have Snake be put in it. The game was too far along though, and Nintendo was still unsure about putting third party characters in it. They made a deal though, that in the next one, Snake would be in it. And there you have it.

@sonicboom457 Rare was sold to some americans. I guess some characters, as K Rool perhaps, belonged Copyrightly to Rare, and with the selling, they got sold to. However, The Kong Clan existed before Nintendo worked with Rare, so the monkeys staid in Nintendos Copyrights. At least that's what I assume
