  • 66-67 mph in the rain...with the cruise control on. Not smart at all.

  • Dude... if I was driving at 50 MPH that night I would be dead! The relative speed of the other car... driving about 100 mph, would have been about 50 MPH and he might not have had the ability to slow down and change lanes. I had the speed set that high because on the GSP (mostly flat road) people usually do 80 in ALL conditions, less than 60/65 is dangerous anytime!

  • You are not supposed to use the cruise control function in wet road conditions. Just trying to help.

  • Nope... with the insurance penalties over 3 years... it would have been MUCH more expensive.

  • Congratulations on your win in court. I must say I'm shocked at the behavior of the Trooper. When I saw the original video, I thought he acted badly. I gave him the benefit of the doubt since he is as human as the rest of us, and he can have a bad day. Going to court and trying to defend the charges with lies is unacceptable. Unfortunately, he is probably not going to change.

  • I thought winning meant walking out not having to pay a $100.00 fine. Nevertheless, if you think you won, well great for you. You really showed them. You and the NE Patriots can celebrate your victories together 18-1 and $100.00 2-point ticket.. Perfect together!!!

  • I paid the fine so as not to have to go to court again. I was facing fines of well over $1000, plus insurance penalties that would amount to over $3000 over 3 years, and, a minor inconvienience of having my license taken away for up to 6 months. Yes, that is a win for me. If I let the judge decide, he might have taken the word of the lier with a trooper hat. My laywer told me over and over I would loose and to take a plea, but I insisted on fighting, reducing my penalty by 1000s of $

  • And, by the way I'm a Giants fan.

  • Actually in most police cars the dash cam goes on when you turn on the overhead lights, not the side spot light. If he shined the side spot light on your truck then the camera would not have caught it. You know the easiest way to prevent this from happening? Don't speed.

  • Let me see here... to prevent cops from lying on the stand, I shouldn't speed. Hmmm... OK, I'll try that.

But, thanks for the point. I don't think this car had a side light. In any case, he did lie on the stand, and I was not speeding. I don't speed. My GPS and EZ-pass proved that I wasn't speeding. The cop was confused as he crossed over, pulled over the wrong car, and that was me!

  • He does have a side light, it was on while you were stopped on the side of the road you can see it reflecting on the hood of the drivers side of his car.

  • Yes, I'm sure you are correct about that come to think of it. All patrol cars have side lights.

  • Good job! You won the fight! You stuck to your guns. You should be proud of your self. Prosecutors in NJ are appointed, not voted in.

  • Thanks...good point.

  • And this officer should be ASHAMED of himself wearing the uniform of a state trooper! To lie in such an obvious and provable way in court! He has no respect for the Bench, no respect for the law, and no respect for himself! Quite a disgrace!

  • Grats on Fighting this!

  • Thank you! You helped a lot, and taught me some video stuff that I needed. My lawyer said that I had "quite a pair" to face 6 months with no license and face the judge. He stood and told me over and over again that I would loose!

  • Is that still Judge Thompson in Tinton Falls? He is known to be extremely fair. Did it seem like the trooper reviewed the video prior to his testimony or did he wing it with a little coaching?

  • Yes, it was Judge Thompson. What a great human being as well as a great Judge. I had the privilege of watching him ruling on cases on several occasions because of my case. He was very fair with me and ruled in my favor on some key evidence to allow it to be admitted, much to the frustration of Michael D. Fitzgerald, PA (Pain in the A...).

  • The trooper did indeed review the youtube video. The prosecutor MF (funny his initials, no?) mentioned the youtube presence more than once and asked leading questions and the officer testified he "refreshed his memory" by watching. I think they were trying to use it against me but it only made the officer look like he didn't remember anything first hand, which made his big liar's lie even more obvious.

  • Thanks. As I said, learning what I learned was disappointing, but reality is what it is!

  • Good for you for fighting this. Your patience has been rewarded.
