Does anyone know of a definitive test for the Nvidia design flaw that would suffice as proof (beyond reasonable doubt) to a retailer that the device was bought with a built-in/inherent fault ?

Seeing this nice CEO dude in full damage-control mode inspired the following two thoughts in my mind:
(1) Boy, Nvidia must have screwed up REAL bad this time.
(2) Damn, he's a CEO of a cool company, and he looks younger than me! I really should have made something with my life!
