Employee & employer are terms defined within subtitle "C" of the code. Also title 20 CFR 404.1001 for participation in federal entitlement programs. Federal law recognizes the fact that human labor is not taxable. See title 15 section 17: The labor of a human being is not a commodity or article of commerce...

Subtitle "C" employment taxes have nothing to do with income taxes. Section 3403 & 3405 make the "Employer" liable, not the "employee".

If any one of these elements are missing from the equation, then no tax can be collected. The I.R. Code imposes just over 2 dozen taxes. All have these three elements. Subtitle "A" is the income tax. Sec.1 imposes the tax on taxable income and provides rates of tax. Sec. 1461 identifies who is "LIABLE". See for yourself.

Here's the real question, though, it's government investigating government. They're all the same, ultimately, so what does it matter?

Option 1: The attacker is going to get off with a wrist-slap.

Option 2: The body sanctioning the assault (The IRS) will terminate the individual and pretend as though the individual was a loose cannon acting unilaterally.

The police investigation will only go after the individual racketeer and not the entire institution that sanctions this racketeering.
