  • the officer should have the right to control the situation as he sees fit so that everyone goes home safely including the other drivers on the road which they were speeding down. or the road crews that are out there working on the side of the roads bottom line massey should have not been speeding (i speed to so don't come back at me with that dumb remark) and he should have done as he was told would have been a lot better for every one

  • @bigsxy0255 They had to pay the 40K because the cop used improper procedure to remove the barbs of the taser. He didn't wear gloves and didn't take a necessary precaution.

    I looked into it because I didn't see the cop do anything really wrong either. What I found was that the cop was found to have acted within his rights, the taser use was found to be justified because of Massey's actions & refusal to cooperate, & Massey did pay the ticket. The cop ignored procedure in removing the barbs, tho

  • I don't know if it's a law or not, never said it was. But, the driver's behavior was juvenile (to put it mildly). He was behaving like my 3 year old son on a bad day. The officer was simply doing his job. Any responsible, mature driver who has taken a drivers test and gone through driving school knows you don't argue your case about a speeding ticket with a cop, you do that with a judge in traffic court. The driver clearly escalated the situation.

  • Cop may have over-reacted and could have handled this better, but it is definitely the driver's fault. Just sign the stupid ticket. It's not an admission of guilt, just that you received it. Driver was being stupid. Argue your case about the ticket in court, not with the cop. Don't you know anything?

  • That's not true. The officer is not obliged to read him his righs in order to put him under arrest. Plus, anyone can be held for up to 48 hrs without being charged.

  • To me, him being tasered was far more safer than either a potential fight with the suspect or even a chase. The suspect kept asking questions the officer already answered like "why did you pull me over??? The cop answered that a dozen times over.

    However, once he is arrested **AND** in the car, he should have been read his rights. However, the officer doesn't have to read their rights before handcuffing the suspect... especially in a potential chase.

  • It would appear that the officer may loose the case. The speeding guy has a strong case with the police officer following procedure. interesting. scratch the comment about signing the ticket. The speeding guy is not guilty for not signing the ticket. my bad

  • In addition. the officer should have read him his rights.This may or may not help the speeding ticket guy in his case. When battling the state in court, the state will pull out all tricks to convince a judge or jury.

  • This is an interesting case. your comments about the wife and child in the car have no validation in the situation.Are there times where police get out of hand? Yes. The guy should have signed the ticket and appeared in court, but since he states he was not going to sign the ticket, this was the basis of the arrest.and resisting arrest in the way of not following the instructions of the officer.
