  • This is such a crock of shit. If it were the other way around which it has been in the past courts would rule that because you are in a public place you should not expect to not be recorded. That, and the camera is pretty fucking visible. By the way im actually undergoing training to be a cop and I think that he was out of control and they need to look at him not the other guy.   • The tropper was fine in what he did I thought. Maybe a little overzealous. To me the big issue is with raiding this guys house over the video and trying to prosecute. Even after the federal appeals court ruled that it is ok to video police and to my knowledge all cases like this have been thrown out, Prosecutors in Illinois are still trying to prosecute 1 man for 75 years in jail for video of police. 75 years?!! they have their priorities backwards. what are they so afraid of? they video us

  • His case got dismissed. As of Sept. 2011 there were 3 states that outlawed videotaping police. However also in Sept. 2011 a federal appeals court ruled that videotaping police (city or state workers) was well within everyone's first amendment right. In this case, this guy wasn't looking for police to video. the cop just pulled up and jumped out. How was he supposed to do anything. Cops are paid by taxpayer money. what are they so afraid of? Please don't say it's an officer safety issue.

  • @chisleu Just to add my $.02, as someone that carry's and someone that rides. My first instinct in this situation would not be to pull my weapon, it would be to haul ass. There is no way in hell the rider has enough time to either pull up or unzip his jacket and draw. Don't forget he is wearing riding gloves too. If I didn't think he was a cop, I'd let go of the clutch and haul ass...or just F*#kin ram him as he stepped out of the car.

  • @realfastbill Yeah I can see that as well. I don't use gloves unless I have to for those reasons. I can't wait until I have some rock protection so I don't have to wear them in warm weather on high speed roads. My jacket has quick zips (~2" long zippers) and I can draw very fast, however at point blank range, I wouldn't even pull the gun out until after my first shot. The point is the cops have got to stop doing things the wrong way.

I know some local cops and they always display their badge even when they are off duty. I guess I am a bit insulated from a lot of crime.

  • The problem is DA's will not prosecute cops! Legislation needs to be passed as to not allow a DA to refuse prosecution on an officer. Prosecution will be automatic, and should be in front of a jury. Let the people decide his actions, fate, and whether or not he will continue to be an officer.

  • @7digitalSunday Well, not anymore, apparently, according to the ruling on this case. The judge dismissed all charges against Graber except for the traffic violations. In her finding she noted specifically that the wiretapping laws were not applicable in public areas where no reasonable expectation of privacy exists, that public officials have no right to have their actions, while on duty, shielded in any way from the public, and that filming in public is a first amendment right.

  • This guy was not filming the cops specifically. He was recording his ride. I guess the cops got upset that he was seen being aggressive in plain cloths with a gun. This could have turned out tragically. If I can be filmed in public, Cops should be too. If you are not interfering with police work, then what is the worry except to hide your dirt.

  • The rider was clearly being stupid and reckless. However, the cop fucked up quite a bit. The guy is, unfortunately for the police, well within his rights as a US citizen to free speech--something called the 1ST AMENDMENT--to film while he rode. My guess is that the camera was clearly visible, so the cop entrapped him by running in front of the camera (the marked cop car stayed behind him.)

Plainclothes officer, unmarked police car (I didn't even see lights), with gun drawn? "Get off your bike" 3x w/o identifying himself? Maybe if the car that cut in front of him was the MARKED cop car that was there, anyway, RIGHT BEHIND THE RIDER, and a UNIFORMED officer jumped out--then he would not have had to identify himself as it would have been obvious! Plus, like I mentioned, if the driver was trying to run, he could have easily have done so through the stopped traffic. He was stopped, when his1st amendment rights and other civil rights were clearly violated.

The camera was in no way recording police, the officer ran in front of his camera--huge difference; I'm thingking it is similar to how the cop overreacted with his gun: "..he held the gun to his side...we think he acted appropriately.."

U're GUILTY!!! Ask the police did they USE to be racist? They'll say OOH WE'VE CHANGED!!! THEN by THEIR OWN STANDARDS...THEIR GUILTY!!!   • @lej047 I think the sticking point is on "audible recording" aka recording voice and not just an image. it's a joke, and the sheriff's/trooper's office decided to take advantage of the law on the books when they heard it made youtube... what a mess of a situation...

  • thats exactly why i always have my cam on....even though im legal, you never know when a cop or more likely a forest ranger is going to pull a stunt thinking im some 15 year old kid and that nobody can see what hes doing on some back trail. He had NO reason to draw a gun and tried to sue when he knew he was in the wrong. I got a LOT of respect for the law....none for the ones that think they can use authority to bully others!!!

  • what do the cops have to hide? that they would make this a big deal so that lawmakers in congress would try or even pass laws against this? the guy was being a jerk(admittedly), but only wanting to film himself. then, a cop shows up and does his job. nothing wrong. cop was good. it's the fact that they realized later that cops can be filmed....not good!

    so now it goes before congress that a law gets passed that it's against the law to film the police. Especially when they are not doing good

  • OMG, I'm sorry, but if a plain clothed individual got out of his car with a gun drawn, I will do the same. The officer should have thought of that. I mean, what if I mistook him for an assailant? I would be a cop killer, provided he didn't shoot me first.
