  • I totally agree with you, especially since about 10 of my videos were either taken down or blocked do to copyright. All of which were parodies, which are legal under the copyright act of 1976.

  • Hi I am Marchingtroop. I really agree that this copyright thing needs reform. I am still new to youtube and right now I am making Vlogs but I would like to make videos with more conten in them but I do not want to infringe on someone's copyright.

  • There really does need to be some kind of reform. Google is a fabulously wealthy corporation; even if it would be a lot of work I'm pretty sure they can afford to hire enough people to take care of it.

  • Couldnt agree more. I've been false DMCA'd myself, and its galling to know that to fight the claim, you need to give the claimant your home address. Let me give you a real scenario here on YT.

    1) Some troll decides they dont like your message.

    2) Troll sends you an ambiguous death threat.

    3) Troll DMCA's your video's

    4) You counter claim.

    5) Youtube gives the Troll your telephone number and home address.

    This needs to be fixed.

    You just don't know what's legal and what's not

    Take Video games for instance

    According to Youtube themselves, its all good as it falls under "fair use" plus you've got youtube partners that are video game uploaders so this leads to people thinking "Oh right, it must be legal to upload video games to Youtube" but the next thing you know, a video game video has been taken down

    It was fair use and parody. It was at most a minute of a 22-minute Simpsons episode, out of seasons upon seasons of episodes. On top of that, it was edited so it had music added and several parts were edited to have a few frames looping for a few seconds. It was not theft. Go fuck your mom.

  • I had a very simple video taken down that I made. It was a television commercial for the EV1 that showed footage of the car and stuff. To this day I have no idea why it was removed.

  • Heh, the DMCA system is still flawed and will continue to be flawed. Its too easy to fake claims with bullshit information. I've been falsely filed by some faceless asshole twice and it took my channel down. This same person filed claims against many other users that used his content under Fair Use. I counterfiled both the claims and finally got my channel back.

  • I agree that this is definitely a problem. I would hate to see a video removed, mine or not, because of someone sending a false claim.

    My only problem with the system is how do small users take down things based on copyright? I do post my art online but how would I get my art that someone isn't giving me credit for taken off in case of that event.

    Other than that this would be a massive improvement and I would love to see it happen. Doesn't sound like it would be too hard either.

  • I use a notary who holds a trusted digital ID. It's no big deal. She files legal documents all day long using email... She isn't inconvenient either, for $20 she comes to my door. She has my ID on file so it's "here's the file, and here's the money" and 5 minutes later it's done. Positive identification is essential in assuring accountability. There is no excuse for turning over a channel owner's personal info to someone that YT hasn't even identified in the original claim.

  • Even if I made a video I probably wouldn't post it on youtube because I would be afraid of a "Copyright Infringement Claim" which could be fake for all I know and on another note I want to put up a video with music from my cousin's band which only has one CD out and no agreement with a record company like WMV and see if they would take it down because of "Copyright".

    so why do company's like MMG have the power to:

    -'scan' EVERY uploaded video for copyrighted material before they even become avaliable to the public

    -can take down any video at any time withoud any good and clear reason at all.

    so they can take down a video, and just ignore the complaints if it was a mistake untill they give up

  • A video of mine got taken down because apparently it was breaking some copyright laws, the title was "hacking a coke machine" and had a picture of a coke machine. I then got a so called ban that told me if I uploaded it again I would get permanently banned. They didn't bother to actually check the video..

If they had more allies than enemy's, maybe there would have been more of a clear result for people like I to see. I've done my small part. I complain, I comment, but if there's no clear objective, like steps or stage or directions, then I can't do much. How can they yell at me for not doing something if they didn't tell me that thing?

    The main concern on my mind and those of my website... Do I need to own the copyright of the videogame being commented or the audio track used in order to counter-DMCA against a fake company named "E&S Productions Incorporated"?

    Fear of "jail time" makes me hesitate if I don't own the games in my videos. I know for a fact neither does "E&S Productions Incorporated".

  • @worldfamouskire667 I really cant give any legal advice on this. All I can say is that you need to look up the copyright act of 1976. In there you will see that you can use copyrighted materials for the use of commentary or criticism. Yes, there are companies that make false claims against peoples videos. This does happen. Make sure that they are in fact the owners of the work.

  • I agree. I was false banned on Kire667 with 1050 friends 650 subscribers after 2006-2010.

    On April 2nd 2010 I was banned due to "E&S Productions Incorporated" claimed they own the game Prototype or maybe it was due to the audio R Kelly "I Believe I Can Fly". Typically they mute audio and ask us to use audioswap. But this time I was banned by a company that doesn't exist or doesn't have ANY claims to DMCA against my video.
