  • More shonky 'journalism' from Fox. Watch the whole thing and you'll see the proper context. This bloke rocked up uninvited to an awards ceremony on private property. When he was refused entry he hung around making a pest of himself. When security politely asked him to leave, he wouldn't. They explained to him the concept of being on private property at the invitation of the property's management, but he couldn't grasp it. So they momentarily detained him to explain the options then released him.

    We have a hugely different interpretation of what happened. He was on the sidewalk; he had every right to be there. And the irony of the situation was indeed extreme.

  • @DreamWorldwide Actually I DO know the legalities here, unlike yourself. He was on PRIVATE PREMISES. That's it. And he can be removed from said premises for any reason -or even none at all. It might LOOK like a sidewalk, and it IS a sidewalk. But it's not a public sidewalk. It's a PRIVATE sidewalk. Get it? It's like a sidewalk at Disneyland: your right to be there can be revoked and if you don't comply, force used to remove you. I thought conservatives understood the concept of private property.

    A sidewalk *inside* Disneyland is not the same as a walkway to a building. Yeah, it could be argued that the walkway was on the building's lot, but they didn't want him to just stand on the sidewalk by the street (which even by your definition would be completely public); they wanted him to go some hundred yards or so (I don't recall the exact amount) away from even that. Again, if he had been trying to bust into the building or blocking people's paths, I'd be with you.

Whatever it is, it's on private property and they have the right to ask you to leave -and remove you if you don't. At the end off the raw footage you can see they escort Ziegler and his colleagues out to the public sidewalk. Earlier, Ziegler can be heard to smarmily protest: "You're breaking all sorts of constitutional laws." Horseshit. No constitutional laws have been broken. Go run it past a lawyer.

    I don't know about that. It seems lawyers *were* involved at some point. And I think what we're unclear on is where public ends and private property begins. You seem to think that anything within 100 yards of the curb is private, at any building at all, but that's not how it works when it comes to where people can protest, etcetera. Also, they didn't just bring him to a "public sidewalk", but completely away from the building. It's not as clear-cut as you state.

Then they told him it was completely clear-cut matter and he didn't have a leg to stand on, so he promptly dropped the matter. Incidentally, you should check out some of the other videos up on YouTube of Ziegler getting forcibly ejected from various places -including his own side, a CPAC meeting. He gets off on it. The man's a nut...

Obviously, Ziegler Makes his points hard, doesn't back down and sees how far he can go until people either respond or kick him out of places (right or wrong) and it becomes news. The drama created helps him in some ways, and hurts in others. We can probably agree on that.

  • @ShayaMusic Access is not always granted to everyone. This is a fact of life, get over it. I cannot put a press badge on my chest tomorrow and expect to be allowed into the White House Press Conference room as a journalist. Zeigler is not a recognized journalist with zero backing from any media outlet except his own. He shouldn't expect to be given press access to a private event because he is... a nobody.

  • After doing some research I found that USC DPS Officers work under the authority of California Penal Code 830.7 (b) which simply states: Police Academy graduates who work for Private Universities have Police Officer Powers of arrest. Mr. Ziegler was advised to leave the private property and he was detained for refusing to do so. Once he was handcuffed and advised again he complied therefore he was not booked. He was granted a second chance, most likely because he is a journalist.

    This would appear very normal in 1930s Germany, arresting a Jewish reporter at a public event for doing his job as the law allows. Back then he would be arrested for being Jewish, here for being a Conservative.

  • Well unfortunately for him USC is a private university so if he was on their property then he did not have the legal right to be there, whether he was doing interviews or just chewing gum.

    I would be curious, however, if those were actual police or just campus mall cops. If they are not real police then more than likely they had no right to physically detain him (even when making a citizen's arrest you can't do that in most states).
