I would say it's not child porn. Not every picture of a naked child is child porn, and some pictures of a clothed child may be child porn. It is obvious from the context of breastfeeding that it is not sexual in nature when the photograph was taken (no child was endangered) thus is not child porn.

It's not an act of child porn I see no problem with it being in a collection of family photos. However, selling and distributing a photo of an underage girls breast fits into the legal definition of child porn.
The tricky thing here is that she is a celebrity and there's more to selling the pic than just the fact that it's an underage girls breast. But to somehow amend the law for cases involving celebrities would be ridiculous.

I would say it's not child porn. Not every picture of a naked child is child porn, and some pictures of a clothed child may be child porn. It is obvious from the context of breastfeeding that it is not sexual in nature when the photograph was taken (no child was endangered) thus is not child porn.

I just checked Swiss law about this matter: This photo, according to what they say can be seen on it, is NOT child porn at all (it's probably not even porn) and the distribution, possession of that material would be legal under those circumstances.
Of course it shows a rather intimate act and does most likely hurt the girl's dignity, but US law doesn't care about those things anyway.
After all, it's not child porn, but it's funny how those hosts are afraid of being sued :D
