You can't put someone on trail for something that wasn't illegal when they did it.

Trading in mortgage backed securities wasn't illegal.

The framers put this in the constitution for a reason. It's common in dictatorships.

Saddam made trading in foreign currency illegal, and he simultaneously arrested the people doing it and chopped their hands off on state tv.
