To answer your other question. I'm not convinced that Mumia's gun fired the fatal bullets. The medical examiner visually identified the bullet found in officer Faulkner's head as a .44 caliber. Only after he learned that Mumia possessed a .38 were the bullets identified at .38 caliber.
@BanuHaqim I'd be very curious to know what you think happened that night. How a gun registered to Mumia ended up firing 5 bullets (but according to you, not by Mumia). How two of those bullets ended up in a cop, and how a cop's bullet ended up in Mumia's (according to you, the wrong person's) chest. I'd also be very interested to know why you think Mumia pleaded the fifth if in fact he had nothing to hide. It all points to a very logical explanation...at least the jury saw it that way.
Mumia and his brother would likely not want to give testimony had Mumia's brother fired the shots. More to the point, I don't have to prove that someone else did it to doubt Mumia's guilt.

What do you know about terminal ballistics? The fact that the medical examiner found the bullet inside of Officer Faulkner's head tells us that there was no exit wound. A .38 will not produce a "gaping" entrance wound. The entrance wound would be little larger than the diameter of a pencil.

During the initial appeal in 1999, he had several attorneys who were divided whether to use Beverly's testimony. His senior counsel argued against it and Mumia went with them. They were however later fired by Mumia.
Abu-Jamal's next legal team revived the Beverly affidavit. Claiming it had been hidden from them, on 4 May 2001 they petitioned a federal court to have Arnold Beverly deposed as a witness.

During a press conference in 2007, Bryan was asked about Beverly and his confession. He quickly responded that "Beverly was not an issue in this case," that "Beverly was rejected by Mumia years ago", and probably most damning to the Beverly myth: "we don’t need to make things up".

@CorruptPhillyCops I saw a cop once beating someone on St. Marks Avenue in Manhattan. When the cop told me to move away or he was going to arrest me, I went to a telephone and called 911. This was before the days of cell phones. It is important that we report every incidence of violence. I often stop violence between people, but with a cop, it's not so easy. It has been easier for me to stop the violence I've lived among in Mexico. I simply say stop and they listen. Go figure.

To answer your other question. I'm not convinced that Mumia's gun fired the fatal bullets. The medical examiner visually identified the bullet found in officer Faulkner's head as a .44 caliber. Only after he learned that Mumia possessed a .38 were the bullets identified at .38 caliber.

What do you know about terminal ballistics? The fact that the medical examiner found the bullet inside of Officer Faulkner's head tells us that there was no exit wound. A .38 will not produce a "gaping" entrance wound. The entrance wound would be little larger than the diameter of a pencil.

If the state can produce and untainted evidence against Mumia or his brother, I'd be all in favor of executing the guilty party. Again: the prosecution doesn't have to provide any evidence whatsoever for the jury to convict - they just need to prove his guilt beyond a shadow of reasonable doubt. Get it now? PS - Mumia himself - not Mr. Jackson - helped pick the jury - using 10 of his 15 peremptory challenges himself.

@BanuHaqim I'm not talking about Miranda rights nor Suppression of evidence. Nice try, but these don't even come close to addressing the issue at hand. Again, the prosecution does not need to provide any evidence, they just need to prove his guilt beyond a reasonable doubt. Something that the state did easily vs Mumia. Something the jury that Mumia helped pick agreed with. Case closed. Sorry.

The "right to remain silent" was only one of several issues that were settled by that case. One of the other items was the state's burden to prove someone guilty beyond a reasonable doubt. How do you suggest the state is supposed to do that if not with evidence? Anything that the state puts before the court it, by definition, evidence.
