The Maddow and Guest reactions are quite radical. The law of war allows for the detention of belligerents who support a hostile organization. Evidence must be presented that such support occurred before someone can be held. It was done during the Civil War, General George Washington did it, and it occurred again in WWII. Of course, the preferred route is to be tried via the criminal system (I notice that piece was conspicuously missing from the segment), but the world isn't always so neat.
