I heard commands to rollover multiple times. I also know that domestic disturbances specifically those involving domestic violence can be deadly for responding officers. It did sound like someone was out of control, especially for an officer to yell to roll over repeatedly.

If the suspect is not cuffed and is squirming around and the officer is commited in a lawful strike and the suspect ends up getting hit in the head, it is the suspect's fault by resisting. If an officer intentionally strikes someone in the head, the officer is subject to disciplinary actions by IA and or the DAs office.

Im from san jose and from a gang related neighborhood. when i was in my teens i was always getting detained by SJPD. i never showed resistance but was treated like i was.

Thanks to technology this type of brutality is no longer getting swept under the rug. San Jose cops have been in the news quite a bit the past couple years. Mardi Gras is coming up, I'm pretty sure they'll be some vids to follow of SJ cops beating folks in downtown.

If police officers are ordering you to put hands behind back, lay flat, etc. and you refuse, they WILL use force. The force WILL continue until you comply. Baton strikes to the upper legs are an acceptable way to gain compliance. If it hurts, you can always comply. If one disagrees with the reasons for their detention, this is addressed in court. You DO NOT have the right to resist the police. So, where is the brutal beating?

Simple as this: Resisting Arrest and Disobeying an order from a Police officer. Cops are there to do a job and I can tell you that Most cops 98 out of 100 only want to get home to their families. I have been on many ride a longs with my local PD and all they try to do is their job. If you resist arrest or disobey an order from them then you better just comply. If you are innocent then all will be cleared. If you do not like the cops move out of the US and see how you like their law enforcement.

I heard commands to rollover multiple times. I also know that domestic disturbances specifically those involving domestic violence can be deadly for responding officers. It did sound like someone was out of control, especially for an officer to yell to roll over repeatedly.

The guy was Vietnamese and his English wasn't perfect so he kept rolling over (back and forth) because he didn't get what the officers wanted him to do. The officers then felt like whacking the crap out of him because he didn't get it. They are supposed to use the least force necessary to restrain someone... and they hit him after he was face down with the cuffs on.

Look, let me inform you the way things work with Police Use of Force Policies. In the performance of an officer's duties, the level of force to be used is that amount which will overcome resistance. It can be escalated to include deadly force depending on the situation. If Police grapple you to a prone position, it is because they want you there. Not all tactics are kind and gentle and they aren't designed that way for a reason.

This guy had to get multiple sets of stitches from this beating, including where they hit him in the head. I work with the severely mentally ill and am trained in restraining techniques. Belief me, this was wholly unnecessary. I've never had to beat someone on the head to get them pinned. It's inhumane.

During the training process, officers are trained not to hit in certain areas. Head shoits are not allowed. If the suspect is not cuffed and is squirming around and the officer is commited in a lawful strike and the suspect ends up getting hit in the head, it is the suspect's fault by resisting. If an officer intentionally strikes someone in the head, the officer is subject to disciplinary actions by IA and or the DAs office.

Cuffing constitutes detention and/or arrest.You can't just cuff everybody at a call. You must articulate your PC for that action.Unless you arrest someone first they can justify self defense for excessive force. It is an easily won Lawsuit otherwise. I've won several.

When an officer detains someone he or she can cuff that person for reasons of iffcer safety and like you indicate, they must document why that person was detained and cuffed. A Law enforcement officer can also "Unarrest" someone.
You don't always need PC to cuff someone...reasonable suspicion is enough in most cases.
