FACT: Matters covered by law between nations are not of the type handled by domestic courts--why else did you think there was a need for international law to begin with? why else did you think sovereign countries needed to come together to agree on rules governing their own conduct towards each other?
It can be coherently argued that someone fighting against his own country's government and on behalf of another foreign body is simply committing TREASON--thus should be charged of that before a domestic court, if not a military tribunal.
This is one view among several which make sense. Which still does not mean that other views also have as much merit.
However, the same cannot be said of those belonging to II-1--
1 not when they do not belong to any country's armed forces;
(Just because you are a Saudi fighting in Afghanistan supported by Pakistani intelligence agents does not mean you belong to the armed forces of Saudi Arabia, Afghanistan or Pakistan.)
2 not when the war they themselves declare/acknowledge they are fighting is not yet over;
(A common criminal mugging a Westerner on the streets of Hanoi, even if the victim subsequently turns out to be a US soldier, does not become a Vietnamese Army Fighter, nor gets sent to Guantanamo.)
3 not when their own countries will not even take them back;
(FACT I: Countries which these people come from did not send them to places where they were subsequently found--they are individuals acting on their own accord and now facing the consequences of their individual actions.
(Thus nothing in what they do necessarily puts another country on any legal standing vis-a-vis America under international law.
(FACT II: Countries which these people come from are themselves not immune to these people's addiction to toppling governments and killing everyone serving it--why would the Saudi, Yemeni, Pakistani or Chinese governments want within their borders someone who wants to topple them, too?
(Do you see many countries apart from the UK and Australia wanting their citizens back? Do you seriously believe that even these two countries' governments believe in these people's innocence?)
The matter of whether torture is indeed employed in Guantanamo deserves EXAMINATION.
