    Not only is it unethical, it is illegal under U.S. Title Code 18, 1466A, which criminalizes: "visual depiction of any kind, including a drawing, cartoon, ... that ... (2)(A) depicts an image that is, or appears to be, of a minor engaging in ... sadistic or masochistic abuse."

    Oh, and by the way? § 1466A (a,b,c) have yet to hold up against animated content as far as I know. I've yet to see any case involving animated content alone go through. Good luck!

    And why does nobody sell RapeLay in the US? Here's a hint from a U.S. Dept of Justice press release (5/20/9):

    "Handley today pleaded guilty to one count of possessing obscene visual representations of the sexual abuse of children in violation of Title 18, United States Code, Section 1466A(b)(1), which prohibits the possession of any type of visual depiction, including a drawing, cartoon."

  • I don't believe that the depiction of a computer-generated model from a video game who does not exist being slapped constitutes as promotion of sexual violence against children in real life. That would suggest people cannot tell reality from fantasy, to which I wholeheartedly disagree. Those who cannot tell the difference are at fault, not the content they observe.

    Aren't there much more important roadblocks to your "ethical society" than YouTube? Wouldn't your time be better spent elsewhere?

    And how do you know that condoning the fantasy cannot lead to an acceptance of the behavior? And why risk it?

    Btw, in addition to U.S. v. Handley I cited, please also see U.S. v. Whorley as a second application of § 1466A against cartoon depictions of child abuse.

  • Once more, I do not agree that a computer-generated model constitutes as reality. It was not reality when it is created and it cannot become reality. I find those who cannot grasp this concept disturbing, as there are many more fantasies portrayed in the media which would be catastrophic if treated as the reality they are not. Therefore, I must resign that fantasy is nothing but.

    In U.S. v. Whorley, there was evidence including actual child pornography. It was not based on animation alone.

    Again, why is producing virtual-reality child abuse as a form of entertainment ethical? You've just claimed without evidence that it cannot promote similar real-world behavior. But that's just an empirical hypothesis, not an inherently ethical argument.

    About Whorley, I've shown that twice § 1466A was successfully used against animated child abuse versus your guess that it never had been. So how does your video fall outside § 1466A?

  • Please note that while Handley was obligated by his defense lawyer to plead guilty on a single count of possession, he did in fact overturn § 1466A subsections (a)(2) and (b)(2), with a federal judge concluding that these subsections were unconstitutional as they violated the First Amendment. As it is under these provisions that you request I remove my video, I must once more decline.

  • Handley awaits sentencing later this month for violating 1466A(b)(1), which incldes cartoon depictions.

    Re Whorley: "The court ... upheld Whorleys convictions for the emails, as well as for the drawings and photographs." [*] (There are reasons why RapeLay isn't sold in the U.S.)

    So if only by Whorley (as obviously not by any ethical argument or innate conscious in you) you should remove the offending video.

  • As you and I have both noted, Handley is not being sentenced under § 1466A (b)(2) which is the basis for your argument against this video. § 1466A (b)(1) cannot be used because this video does not fall under either of the categories it presents.

    The Whorley case, as it is not specific to this content and occurred prior to the Handley case, is not applicable either. Please refrain from commenting further or I will be forced to remove them for being disruptive. Have a good night.
