  • If someone for some reason didn't like megaupload or simply doesn't care, I say to them it starts with one thing and doesn't stop there it will continue like cancer cells in till it wipes out every other site there is. So people wake up and start acting now because sooner or later they will take away all your rights and privileges. Be wise with all that you do!

  • Really well explained! I got a really bad virus from megaupload... broke my computer and had to pay $150 for a repair.

  • @calebcharlebois12 Apprently you don't get the point. It's not (Megauploads) fault you got the virus it's the person that distributed the file. Megaupload didn't upload the infected file someone else did.

  • It would be nice to know how the FBI had authority to enforce US law on a Hong Kong based company and how the DCMA allows Criminal prosecutions rather than Civil liability. The fact that the dotcom was arrested and not merely sued is disturbing.

  • Good job explaining the "perplexity" of the FBI's allegations and actions, as well as explaining what it is that recent news stories surrounding "SOPA" and "Megaupload" are referring to in regards to "piracy". You are quite right that it is "a bit vague". Good idea using your own content as an "example" (the YouTube Vs. Megaupload "DMCA procedures"). You definitely broke down the various aspects in simple, easily digestible pieces and kept it interesting at the same time.

  • A friend uploads his music on (another) filehoster and earns some 100-200€ per month through it, for his hobby nontheless. He doesnt have to pay the bandwith, infact he earns money. Maybe they fear musician getting all the money for themselves.

    Instead of arresting the people behind Megaupload they schould look at their system and try to emulate it and earn their money this way.

  • But, it is also important to understand that MPAA/RIAA wanted it down too. I doubt any site that has the same technical practices will go down if they are not a target of big lobbies.

  • You are missing important points. DMCA is not only about deleting content on request.. You have other obligations such as blocking repeat infringers.

    What's important to understand in the Mega case is about their technical structure : they hosted a single copy of each file and many different URL to it. When someone would send a complaint they would only delete 1 URL and keep the file for everyone else. That is a breach of the DMCA.

  • I agree with lots of this but if you went on tvshack.com (now shut down) a couple of weeks ago, nearly every single film or tv show had a link to megaupload. So I think that it is a far dodgier company than YouTube.

  • Thanks this was really informative. Light years away from Mike Mozart's fear mongering video on Megaupload. Actually if you could, could you explain why what he says in his most recent video is just 100% wrong? He claims that the uploaders and downloaders from Megaupload are going to be hunted down by the FBI, fined millions, and then thrown in jail. It seems silly but it seems to be causing a lot of panic. People are talking suicide, fleeing the country, etc. Can you please clear all this up?

You make an interesting argument for why think Megaupload shouldn't have been been shut down, but you contradict yourself when you list the things that Megaupload did that pretty much guaranteed that the site would eventually be shut down! Further more Youtube has several programs in place to try and thwart the illegal upload of copyrighted material that you failed to mention. Because of their business model, Megaupload's days were numbered from the get-go. Sad, but true.

  • Pretty good man! Keep it up! I think however this sets a precendent, even Napster had a lengthy hearing before it bit the dust. Its better to go through the process rather than get shut down with the snap of your fingers. I guess that means we aren't a free society anymore.

  • The funny thing is that since torrent etc. emerged, CD and DVD sales have gone up, explosively, because people get a better chance of finding the cool music and the saying "Hey, i like this, so i will support and by buying their CD!".

    Before you had no real chance of doing that, and therefore alot of people didn't really get into music the way people do now.

  • Warning, the following is constructive criticism.

    I like what you are doing but you are talking a bit fast, repeating much of the same thing, and jumping around a lot in your points (getting details from each all mixed up). Slow down a little, don't jump around on your points, and don't repeat parts of what you are saying so many times (short & sweet) and this will be quite good. Again, I really like that you took the time to put this important message out here. Thumbs Up.

  • i agree with you, megaupload is not liable for any of these, its the uploaders that are.

  • wasn't the servers in US. but regardless of what those servers contained (porn or not) its still the users that was uploading the content to them, not the owners. the owners can not be held liable for what the users upload to the service. This is basically sending a message to anyone with a website that allows users to post content, or links (a forum) in that they can hold the owners liable for the content that users are uploading and these users can get away scott free. Its downright retarded.

  • @madmax2069 and like you said if these users mask the file name and alter the files size and make them multi part rar or zip files how are they to know what these files contain, the same can be said about video, users can mask the file name, reverse the video output and so forth. it makes it hard to weed out the illegal stuff when you have so much of it being uploaded.
