Klein does not say the Constitution is not binding. Klein says the simple act of a Congressional reading of the bare text of the Constitution has no binding power on anything. Congress could well still pass laws later found by the Supreme Court to be unconstitutional, just as in the past. That's why we have the Supreme Court. A fair "reading" of the Constitution would include not just the original text, but the text of every applicable Supreme Court ruling. Won't happen.
