Note that Obama was talking about imprisoned terrorist suspects who are not citizens of the United States. As such, the rights guaranteed by the United States constitution do not legally apply to them. Obama, being the Commander in Chief of the armed forces does in fact have the power to imprison foreign suspects for as long as he so pleases.
