  • I live in Winnipeg. We had a case where a person held a sign warning of a speed trap ahead. The cops confiscated his sign and threatened him with arrest if he didn't leave. When the press got a hold of the story, as you can probably guess, the cops lied and denied they had in any way threatened the sign holder. However, shortly after, the next time another sign holder did the same, the cops packed up their speed trap and drove away. They're nothing but a pack of lying bastards...

  • They can't arrest a person for a traffic violation and then have PC to look for a gun. Your example was a good illustration of that. There has been some changes when an officer tries to search based on securing a scene which was argued in Gant v Arizona 2009 USSC.

  • That is what I explained you just stated it another way. The protective sweep came about from a Maryland case that the USSC ruled was ok. As you stated and as did I a police officer may search a person incident to arrest so long as they have pc to arrest. A seizure requires mere suspicion but once an officer wants to move a suspect i.e. arrest then he needs PC. Regarding searching a person's automobile incident to arrest the PC they have to arrest must be enough to get them in the car.

  • @BatmansArse Police departments are a monetary burden on the counties/cities. That's why so many are getting laid off in this economy -- the departments are very expensive to operate. Revenue generated from tickets does not directly go to the police departments, and it is only a fraction of what it costs to run the department.

    The idea that the police are "for profit" is laughable; they produce no profit whatsoever. Remember, everyone who is locked up costs the cities money.

  • @GODH8ZZ Some courts have ruled on it... I didn't say the Supreme Court. Case laws have jurisdiction. For example, a California Supreme Court case covers, in essence, only California.

    Everything the police do is indeed not Constitutional; however, an officer is not found guilty of any crime or neglect of duty if he performs in accordance with what he can know; that is, if the current statutes and case laws support his actions, they are just, even if overturned by the courts later.

  • @GODH8ZZ For example, many Americans think that a warrant is necessary for a search or seizure. Some Americans, particularly Sovereign Citizens or "Right to Travel" folks demand a warrant for an officer to even stop their vehicle or person.

    These people are WRONG. Read the 4th Amendment, it protects you from warrantless searches and seizures that are UNREASONABLE; thus reasonable searches & seizures do not need a warrant. See how easy it is to misunderstand rights in the Constitution?

  • @FoxeoGames Are u an attorney? Even if police conduct a reasonable search unless there is consent they need PC(which is more than a mere suspicion, which is required for a seizure. That is based on the precedent of Terry v Ohio USSC 1967). Moreover, if they have PC that is enough to search an automobile but to search a person's home a they have to show a judge there is enough PC to issue a search warrant. Also, to come into your home to arrest you all that is required is an arrest warrant.

  • @philliesphan312 I'm not an attorney, I'm a local LEO. I've been schooled in criminal and procedural law by an Assistant District Attorney who formerly worked as an FBI agent. He is a well-known local legal scholar.

    Search of a person incident to arrest always applies given the PC for the arrest is legit. Inside a home, they can do a "protective sweep" only given the person is present and arrested.

    Automobiles are no longer included in search incident to arrest by default.

    However, automobiles can be searched incident to arrest if the officer can give PC to believe that evidence related to the arrest is concealed in the automobile.

    For example, you arrest a felon for having a firearm on him, but the magazine is missing despite a round being in the chamber. It is reasonable to believe the magazine is likely in the car. It's arguable you could justify searching the automobile incident to the felony possession arrest.

  • @FoxeoGames Once they arrest inside a home they are allowed(without a warrant to search the person because incident to arrest is an exception to the warrant requirement and within the person's wingspan. All of this is void once a person gives consent to search so never allow it! Consent is one of the exceptions to the 4th amendment.

    I firmly believe that no legal citation should ever be viewed as a source of income, because it makes a traffic citation another form of taxation, and everybody knows we have way too much taxation already!

  • @FoxeoGames Tickets bring in more than 10x what it costs to run a police department.  you are the one with a ridiculous assertion. groups of cops at radar checkpoints can pull over and write upwards of 30 tickets in a period of just 1 or 2 hours at over $50 per ticket and that is like 1% of the cops in the department. the revenue collected is enormous and the profits are giant. its not even an opinion, it is a fact that tickets are revenue collection

    Most departments do not get to spend the money directly. Most departments that issue tickets see the money from tickets go into a general city or county fund that has no direct impact on the department. I agree, however, that they should not be seen as a source of revenue

  • The jogger did NOT help people break the law. Rather, he reminded them to slow down to comply with the law. He actually helped to make the neighborhood safer, whereas, the cop just wanted to give tickets. This reminds me of my neighborhood in which cops gave tickets to those running stop signs that were obscured by overgrown trees. A simple call to the street maintenance dept to trim the trees would have solved the problem. But no! Let's give tickets!
