People who leave stuff behind have no consideration for those who have to deal with it.
Stuff in an attic or spare room is a haven for mice, insects. mold, and other nuisances that will spread into the rest of the property unless someone goes in and cleans it regularly. Get it in writing and pay in advance for the storage and care!
I have no sympathy. I rented a place, and the previous tenant kept saying "I'll pick my stuff up. Just a few weeks/days more". After six months I gave it to charity.
Why would he "trust these people 1000%?" When they were his tenants he 'may' have had justification to leave stuff upstairs, but once he sold the house he didn't own the upstairs AT ALL. If I were the Def. living there, the second the new owner told me to junk the stuff, I'd be digging through it. Maybe that makes me cheap or nosey, but as soon as I know he's left it w/ no intent to get it back, I'd see how much I could get for it. I'd loved to hear the Def. say she sold the stuff for $1,000's!!
Sometimes I wonder...all these really expensive signed pictures & old historical antiques you see on pawn shop shows and Antique's roadshow...where does it all come from? Are there still hidden, missing treasures in the world or does everyone who has them hold onto them dearly?
I guess this case answers my question. Some people are just too stupid to keep nice things.
If he really thinks it's a robbery, then the tenants must've robbed their NEW landlord becuase he is OUT OF THE PICTURE by then
The Plaintiff's former tenants have absolutely no obligation to store items for the Plaintiff, whether he trusts them to do so or not. If these things were that valuable, he should never have left them; it was simply a case of his being too lazy to move them, or not wanting to spend the money to store the items.
I cannot believe that the plantiff would really believe that it was the defendant's fault and not his own. He seems like he has a strong sense of entitlement and thinks everyone supposed to take care of him. He should also know from being a landowner & landlord that verbal agreements are difficult to sue and he should have obtained a written agreement. Last, for valuable items like that, didn't he believe in obtaining insurance?! Yikes!!
I had a roommate, and I threw him out for stealing and other unsavory behaviors, I gave him two weeks to take all his stuff, I called him twice during the two weeks to remind him he had to pick up or his stuff would get tossed, he never called, never showed so I tossed it out with the trash. He called SIX WEEKS later and I told himn I threw out his stuff. He was shocked. He said he had important papers, I said if they were that important you should have taken them with you or picked them up.
@MsFutomaki I doubt that, he's probably dead by now, he drank 18 beers a day and his skin was all yellow because his liver was failing and this was back in 05.
@chickenbiscito i am guessing you mean the D, what is shady or goofy about them. the only thing i saw goofy was the P leaving stuff behind without something in writing
I'd bet the attorneys' agreement was that the P would pay rent to store his stuff there after closing the sale, and he just didn't bother to pay the rent!
How the fuck could you not feel bad for throwing such valuable and important things in the fucking trash? What a stupid cunt this woman is. I understand that the guy shouldn't have left his stuff behind, but christ.
@desertsonata I wouldn't feel bad at all because the idiot has no right keeping his stuff there....especially if it was all that valuable as he claims it was. I have not one iota of sympathy for the plaintiff . . .
@BonsaiBlog yea i used to live in the town where they said the house was (Freeport) and its pretty run down isnt a good neighborhood. There is a rich part down by the bay/ocean, but the rest of the town is mostly lower class hispanic/blacks/white trash. my parents moved us outta there when we were about 5, its not the best place to raise a family lol.
That's so arrogant to think you can leave stuff behind for storage even though the house is no longer yours. I believe they threw out the stuff, they probably just dumped the boxes. He's an idiot.

Finally, an interesting case. I get so sick of scratched cars and g.f.s suing their b.f.s for 'loans' and landlords withholding deposits, etc..
