  • this bullshit about him reaching for a taser is insane. If you've seen the full video, the officer, pulled out the gun, set the barrel on grant's back, lifted it slightly, then fired. A cop who can't tell the difference between a gun and a taser in that amount of time should not be a cop in the first place. I believe full heartedly that he intended to kill. Also did anyone notice that all the cops in the video are white, while everyone they had against the wall were members of minority groups?

  • It is difficult to make a point in <500 characters. I feel now and then I must state that I do not feel that Grant deserved to die, and I feel that Mehserle was criminally negligent and absolutely deserves prison time. This was proven to be an accident, Mehserle intended to tase, not shoot, Grant. Grant was a career criminal who assaulted officers and resisted arrest but that does not make it ok to kill him. Grant should be alive, and both he and Mehserle should be home with their children.

  • @jrowe6 Absolutely. However, we do not punish accidents the same as intentional acts. His actions were criminally negligent and he deserves prison time for sure. My only point is that he did not intend to kill Oscar Grant.

  • @ssn708 if we get rid of the cops being allowed to use tasers in this situation there would be no reason for any weapon to be drawn. tasering for compliance is founded on the basis of torture, it is not a defensive move, it is not to immobilise, it is to put into so much pain you give up your convictions and give in. this is a fundamental flaw in the use of tasers against our own citizens. the system is at fault for allowing this to be how shit gets done, Mehserle's is at fault for incompetince

  • @jrowe6 also, i have seen loads of footage and i do not see much resisting going on here. two grown ass male cops cant keep a hold of a single young man face down on the concrete......? if they are that incompetent i do not want to be paying their salary and i want them off the street. i believe this is murder, sorry, but there is nothing that can make this seem at all accidental or anything that should allow the officer to lower his criminal responsibility. jail for life, or death sentence.

  • @jrowe6 First, Grant assaulted 2 officers (Dominici and Pirone) before they even tried to cuff anyone. Then, when they decided to cuff Grant, he rolled halfway onto his back to try and keep them from being able to cuff him. Then they wrestles with him for 30 seconds to try and pull his hands out from under him. It is not whether they can "keep hold" of him, it is whether they can cuff him! Yews, this was 100% accidental as was proven, he intended to tase which was appropriate to the situation.

If we take away tasers, you leave batons which cause considerably more injury on average and leave officers at greater risk than tasers, meaning they will use them more quoickly and brutally. Tasing for compliance is not based on torture, it is based on compliance. Once the police decide you are going with them, that is what is going to happen, your "convictions" are moot. Your only choice is how much it is going to hurt. Do you think beating with a baton is better?

  • @jrowe6 Pain compliance is not torture, there is a huge distinction. Mace is pain compliance. Joint locks are pain compliance. Your statement is simply false, they are legal and justifiable tools to bring criminals into custody. I guess cops should just hand them the cuffs, or ask them to please come down to the station when it is convenient? Sorry, but this is the real world. When a criminal resists, they will be forced to comply. Go to any other country, resist arrest, and see what happens.

  • @jrowe6 As far as his assaults on officers Dominici and Pirone, this is a matter of court record. There is video of both. The most clear video of the assault on Dominici that I have found was taken down because the poster's account was removed due to numerous copyright infringements. I am still looking for a copy as clear, but for starters you can look here for "Oscar Grant Knees BART officer Tony Pirone in the groin". In the same video you also see Grant violently Grab Dominici's arm.

  • @ssn708 that video does not support what you have said. i think you opinion of the law and police officers is making you biased to whats really happening. you are not seeing what is happening, you are seeing things how you want to see them and twisting the situation. just like the police do all the time to get out of trouble, i do hope you are not an officer. if you are, you may as well stop arguing on here, such a biased point of view is invalid on all counts.

  • @jrowe6 Actually, if you knew anything about me you would know my opinion of police would support the exact opposite of what I have been saying about this case. I am an advocate for citizens over police. However, that also means throwing the BS flag when it needs to be thrown, as it does here. The video proves EVERYTHING I have said, all 100% verifiable. My view is not biased, it is solely based on proven facts. Tell me exactly what you think is false, and I will be happy to prove it to you.

  • @ssn708 just to make sure we are on the same page, in my last reply to you i was refering to the video where the officer was "Assaulted" by Grant. in that video it looked quite clear to me that the officer assaulted Grant and Grant attempted to shield himself possibly hitting the officer with his knee.

    we obviously see things a bit different, i am also a citizens over police type person so i will assume that we share some common ground on alot of things so i'd rather not argue.

  • @jrowe6 It was proven that officer Pirone did not assault Grant. Immediately after Grant grabbed officer Dominici by the arm, Pirone came over, put his hand behind Grant's head, and pushed him to the ground. This is shown in "BART shooting video vindicates officer". Now, Pirone was a fuck, and I would have a lot less problem believing that Pirone intentionally killed someone. As far as appropriate punishment, I feel Mehserle got an appropriate sentence, and no other officer broke the law.

The father in Wisconsin who pulled the gun from its case and accidentally shot and killed his son, how much prison time should he get? Two years is appropriate for a criminally negligent homicide such as this. Race does not enter into it, only race baiting professional victims would attempt to make the argument that it does.

  • Bart should of used a cross draw pursedure when tazer were given to officers. The central valley had this happen same verdict given. A tazer and gun will fell the same in stressfull incidents. You say if he intended to tase Grant he would have made the other officers step back? So he would shoot a .40 cal downward against a hard surface without making officers step back? Ever hear of ricochet? Much more likely he would fire a taser with officers nearby. Ever watch a taser training video? Cops HOLD the cop in training while he is being tased. No need to back up

  • I feel bad for the family of the dead man, but this is NOT murder in the 2nd degree. He will be found guilty of no more than manslaughter and serve 5-10 years with good behavior. Murder requires the INTENT to murder (and this was accidental) and/or a killing caused by a conduct that demonstrates an obvious lack of regard for human life. This case is no more than negligent murder (ie. unintentional manslaughter).

  • Search this on Wikipedia, it details the incident. Also...this guy Grant was a 2 time felon...multiple charges...and is a criminal. I can tell you that if I had to deal with people like this daily...I would presume they all had guns and would not hesitate to pull mine. I served 2 tours in Iraq with the US Marines...and although I dont agree with the shooting...stop praising this Grant guy before we have another Rodney King criminal made into a hero.

  • I love when people use words like "sad" and "tragic" to try and nullify any sense of personal responsibility for wrongful actions. "Sad" describes how Grants parents feel now that theur son is gone. "Tragic" describes the fact that trying to get everyone to calm down got Oscar killed. "Evil," "murderous," and "criminal" are all much more appropriate descriptions for Johannes Mehserle's actions toward Grant as clearly visible in the videos.

It was his assault on officers and resisting arrest, and it was a dumbass cop who panicked and grabbed the wrong weapon. Take either side out of the equation, he would be alive. This is a case where the cop screwed up and killed a guy because the kid was not doing what he said as to giving a lawful order to give him his hands because at this point it looks like the kid was under arrest . I don't think the cop wanted to kill this kid but he did and now he will pay the price of his job and his life will never be the same.

  • I don't disagree with you-- but how do you know you "can't do the job" until you screw up? A friend of mine was involved in a coke bust. They suspected the dealer had swallowed his bags of coke. They wanted to call the EMT to get it out of him but, while in the front yard, a large crowd gathered and became threatening. The perp denied it, his GF denied it. By the time they got him to the station, he was dead.

  • If you look closely, you will see him reach for his belt (presumably for the taser) and then return to struggling with the subject before again going to his belt and drawing the gun. That interruption, while seemingly minor to onlookers could be a key point in how this horrible event played out.

  • Well, I think point #1 is very clear.

    On point #2, from the reports I heard, the taser and gun are actually on different sides of the belt--but I do not know this for sure.

    Regarding #3, hmm, well, I may agree on the "no indication" of premeditation, I think there will be lots of trouble if it starts getting kicked down too far.

  • #2. The TASER is recommended strongly by the manufacturer to be carried on the opposite side as the gun for this very reason. Even if it was in this case, the officer had been carrying it for a very short time (about a month) and could have become confused.

  • Or... if you look at the video prior to the contact this officer had with Grant, you'll see that his handcuffs are located directly behind his duty weapon, with a snap flap enclosure, which is difficult to operate in the kneeling position. Having worked patrol, I've been in the exact same shoes and had I tried searching a subject that resisted on 6 different counts, I too would have been on edge, especially when he jerked his left hand free. I think that's what caused the reaction from both cops

  • As stated before, I certainly do not condone the officer's actions and certainly feel that the officer needs to be charged.

    But since this channel is focused on putting out the truth...

    To be clear, from all accounts that I read, seen and heard, Grant was NOT in handcuffs when he was shot. The officers were trying to get him into handcuffs when the unnecessary shooting occurred.

    Doesn't make it better or worse, but let's stick with the facts please.

  • Looks like these guys are trying to make excuses. #1. A tazer and a gun are operated in different ways #2 There are other videos that show a clear close up of the murder. It shows the officer get up and shot the young man in the back. It dissapoints me that CNN would use the less visible video to make thier case for the officer. They should have done thier homework.

  • You're 100% correct. If anyone's ever fired a gun they know how hard it recoils. As for the tazer defense, aside from the obvious ? of why do you need a tazer in that situation, but how could you become an officer without know the difference? Lastly, this officer better hope that is dept. is not 1 of the many dept. that require their officers to have their sidearms on safety because all tazer talk is dead if that's the case.

  • the core problem here is that there must be a procedure to follow when an officer shoots a man dead. We have no police report, camera confiscation, protection by the higher up of Mersehle, no accountability until other agents of government moved. We have a "suspect" who takes off to Nevada after there have been riots. Extradition? R U F-ing kidding me.

    The officer should have come out immediately and stated that it was a mistake, but instead we see a complete travesty.

  • However, he committed the worst mistake.He took the advise of his dumbass lawyer to remain silent which will piss everyone off, including the district attorney who now charged him with murder because Mehserle's such an idiot. Now Mehserhle appears just plain arrogant without giving a statement. I have to say if I was the jury, that alone would make me convict him to a much longer sentence because of his arrogance then if he just admitted guilt and said I'm sorry....CONTINUED......

  • But this is the stupidest thing...I think Mehserle's attorny may be his worst enemy and put him in jail for good. I mean, after this happened, Mehserle should've just come forward immediately, offer his apology to Grant's family and said I was sorry, I screwed up, I'm human and I make mistakes and that I'll do whatever it takes to cooperate with this investigation and give his side of the story of why he did what he did.....CONTINUED.........

  • Ok, it's tragic for both Grant & Mehserle no matter how you look at it. Obviously, I don't believe this officer intended to kill Grant because he was summoned to break this fight up in the first place. The thing is, he was inexperienced, freak-out because of all the morons screaming in the back, probably stressed out because of the coming birth of child, confused, scared, probably forgot he had handcuffed him and drew his weapon.....CONTINUED..........

  • touche mi amie...there was no intent to kill! Going to be a tough case for both sides though; prosecution and defense. People in Oakland are just bitter and mad at the police. Oakland Police has a very young and inexperience police force. Why do you think Mehserle was place in a BART detail. Because the experience cops patrol the bad neighborhoods.

  • Can someone explain why Grant was even pulled from the wall. Also, the men next to him were not handcuffed.

  • I believe the officer should be charged fully for the murder and there is obviously issues, major issues with excessive force in this incident and other places.

    However, since this channel is set forth to make sure the truth is out there...

    To be clear, from all accounts that I read, seen and heard, Grant was not in handcuffs. The officers were trying to get him into handcuffs when the unnecessary shooting occurred.

    Doesn't make it better or worse, but let's stick with facts please.

  • It does not matter whether he thought it was a taser or not. If it had been a taser, he would still be guilty of second-degree murder.

    You don't pull out a DEADLY WEAPON, which a taser absolutely is, point it into the back of an unarmed and restrained individual, and fire. Accident or not, Johannes Mehserle's wrongful actions led to the death of Oscar Grant, and he must be held accountable.

    PS - People aren't gonna fall for the "people want murder-1" bullshit Rick Sanchez spews in this video.
