Also, let me recommend "Founding Brothers" (a book on the revolutionary era politics). The authors thesis is that disagreement lead to ongoing debate aside from a few cases, and that situations such as that are offspring of the American process. (at least that's what I got out of it). Anyways, its a great book no matter how you interpret it.

First off Abraham Lincoln did not get rid of slavery. He emancipated the slaves in REBEL CONTROLLED territory as a military necessity. However, he had no jurisdiction in that territory, and therefore was really just making a valliant claim. Also, the Emancipation Proclamation, was exactly that, a proclamation. It had no legal merit besides the word of the president.
