  • This DOES work. The car one doesn't. I actually used this one. The police came to my floor (I know. I live in an apartment building so right away I knew something was up) and they said a robber had done a crime and run into this building and they needed to search all the apartments. It takes two keys to get into this building through two locked doors, so I knew they were full of it so I said they couldn't come in without a warrant. They presisted, but I closed the door and they had to leave.

  • Is it wise to exit the house? I talk to them through the window and tell them that I don't leave my house after I've had a beer..

  • Search warrants only applies to the USA!! I can't stress that enough. In Sweden, for example, other rules apply. If you're so much as SUSPECTED for a crime that MIGHT land you in prison, the cops have every right to barge in and search your home from top to bottom however they damn well please and you don't have anything to say about it.

    look up how a search warrant looks issued by your local court. Then, if they have a search warrant, ask to look at it. You are allowed to look at it. If it doesn't match up, it's fake.

    If it's a legitimate search warrant...well...I have no advice for you.

  • You are making the mistake of thinking that cops are bound by the law. You're also ignoring a lot of instances in which what I describe takes place and is supported by the courts.

    Also, "835 F2d 1406" means nothing unless you cite the book it comes from.

    If cops ask to enter your home and you say no, technically that constitutes probable cause in most states. They can tack on 'disobeying an officer' to the charges as well, and then declare the home a crime scene -- meaning you can't go back to it once you get out of the jail several days later.

    You can thank the war on terror wimps for the complete eradication of our 4th amendment.

  • I remember when I use to live in a crazy college party town, being underage I had a huge party at my place. Police came. I shut the door behind me and walked outside, talked to the cop and politely explained that we were having a party. For the most part, I was honest... but not COMPLETELY honest. He was cool, didn't even ask to come in. He just wanted to make sure we weren't irresponsible (which we probably were) and that we were safe.

    It depends on the reason why they are at your house. Most of the time they will need a search warrant though, its not like being at your car being pulled over. you have aot more rights at your home.

When the cops got to my friend in TX, they asked her husband to come out. His ex-wife is a judge & married to a cop detective. When he refused to come out, they told the wife to & they arrested her & put her in jail. Had I not told my CA friend, she would have been also. Cops took husbands "arsenal" but returned them

Reality is, the cops will shove their way in, ransack your home, then testify in court (if you get that far) that you allowed them in willingly AND still use anything they found against you.   • My husband told an officer to not go into our house until he had finished speaking with another officer, and told the 1st one, that when he was done, he would escort him through our house. Of course when the officer went in anyway, we asked for a Sargent on sight and where refused, They took him to jail for refusing entry. He spent 10 hours in a freezing cold cell with only shorts. Yes they did drop whatever bogus charge they came up with, but he was actually the victim of why they were there

I hope your situation gets resolved. I really do love history and wish more people did so they would know and appreciate how unique our constitution and country is.

  • There are numerous times police can LEGALLY enter your residence without a Search Warrant. In Canada, it is clear and observable Case Law that if a 911 call came from the residence, police get to come in and make sure everything's okay (the case involved hubby answering the door, refusing entry, and his nearly-beaten-to-death wife was found in the bedroom). Fresh pursuit of a criminal is another reason for entry-not seeing a fugitive inside, but following him from outside to inside. It happens.
