I agree with cracked apps being illegal. However, jailbreaking is not. You bought the device, you own it. You can do whatever customizations you want with it. If you buy a car, you're allowed to paint it, change the interior, change the stereo, change the wheels, and even modify the engine to go faster because it's YOUR car. It's YOUR iPhone! Not only that, but making it illegal won't stop anything. It's still illegal to download music and movies, and it happens every second of every day.

By the way apple offers an iPhone update for iPod touch users. It costed 4.99 so doesn't that mean that you have to buy the software separately?
