TCAS was developed before this plane crash. The mistake, which has been done in this scenario is, that one crew followed orders of ATC, which crossed over with the orders of the DHL crew, taken from TCAS. The incident of the Aero Mexico vs. the LearJet (I believe, not sure though) was the reason, why collision avoidance systems were developed.
So that's what really happened! All those poor passengers and crew. What a needless waste! May their souls rest in peace.

that is why the pilots should be told which to follow first and foremost- the TCAS or the ATC commands.
