While in the air, seaplanes must give way to other vessels. Since seaplanes are limited in their ability to maneuver on the water THEY normally have the Right of Way on the water surface.
It was the fishermen who failed to give way to the lesser maneuverable seaplane and failed to keep proper watch while underway.

As far as I am aware EVERYTHING (no matter whether it's a motorboat, sailing vessel, rowing boat or a turtle with a pygmy on its back) gives way to a stationary vessel. After all, how can a stationary vessel be responsible for any collision?
