The gitmo detainees do not have Constitutional rights because they are not on American soil. Keeping them locked up does not violate the Constitution. POWs are usually kept until the war is over. Once these detainees are put on American soil like he wants then they will have Rights. Once their on our soil and can be kept indefinitely without charges...then we need to be scared.

The gitmo detainees do not have Constitutional rights because they are not on American soil. Keeping them locked up does not violate the Constitution. POWs are usually kept until the war is over. Once these detainees are put on American soil like he wants then they will have Rights. Once their on our soil and can be kept indefinitely without charges...then we need to be scared.

For example, if a guy goes on a killing spree, a court will likely put him in jail for life to keep him from harming anyone else. That's preventative incarceration (as opposed to "rehabilitative" incarceration"). Second Point: We're not incarcerating innocent people. they wouldnt just keep someone behind bars for 10 years because they "think" that they would be a threat. im guessing they would do a whole background check and see what their psychological state is. if they find them to be a future threat then they should keep them in prolonged detention. youre blowing this out of proportion is you think that they would keep random criminals in prison for minor offences.
