  • Well...How common is common sense really? If 70% of American's used common sense we would all have free health care and education but we seem to think that the top 10% of our country (the wealthy) can decide what is best for everyone in the middle class and people living in poverty.Common sense tells me that if the middle class and poor stopped voting for Republicans whos only issue is to be fiscally responsible we would understand that a right to education and health care should be free.

  • @theIEguy34 Actually, common sense would tell us that $14 trillion in debt means we can't afford any more goodies. Education and health insurance cannot by definition be rights. Rights are individual and exist independent of government and society. They do not exist by taking from others, transfers of wealth and entitlements are. If that's what you want, fine, but don't call them rights. I agree that other officers should be charged. Accessory to murder is a crime. Noone should be above the law.

We have free energy floating all around us and we also have clean electric (AC) that can be used instead of (DC). Don't you see the influx in clean technology and solar panels? To be honest the wealthy are ripping us off...Just look at the price tags on some of the items it costs them 50 cents to make.

  • Florida Statute 901.151 Stop and Frisk.

    Those police officers were good cops. They could have easily taken you to jail if they wanted to just for not providing them with some sort of id , be it verbal or on paper. I personally don't agree with the stop and frisk law as i feel it does violate the constitution, but it is a law non the less.

    You better re-read that law. The very first section of it demands that "Probable cause" exists before the Police can stop and frisk you. Videotaping public servants in public, in the performance of their duties does not constitute "probable cause" - In that case the right to not answer ANY questions, including questions of identity are still in force. A cop can't simply walk up to you and demand your identity or "Papers".. He can ask and you can refuse.

What I discovered is that while my PHRASEOLOGY may have been wrong, my assertion is still correct regarding FL 901.151.   • The officer does not have to tell you his name or his badge number at all. All he has to do is tell you he is a law enforcement officer (as it is obvious with the uniform, badge and gun). With you providing a false name when asked, that is an arrestable offense.

  • The police officers didn't do anything wrong- the two boys in this video provoked them. Although I do believe that civil rights are important, I also think that difficult people like these boys aren't doing anything to advance those rights. They are being smart asses for the sake of being smart asses. If they truly cared about civil rights, they would invest their time into something less frivolous.

  • I'm a civil libertarian, and happen to be a career law enforcement officer. I fully support citizens holding law enforcement accountable. There is no reason that a law enforcement officer would have a problem providing that. Having said that, this particular officer did absolutely nothing wrong, and was respectful and polite. He provided his business card, which he does not have to do.

  • THe woman officer was wrong in this case. There was no probable cause of your wrong doing. As given by Brown v. Texas this court decision says that the person does NOT have to identify itself to police with fear of arrest unless there is probable cause, otherwise it violates the 4th amendment.

  • WRONG ! Federal law requires ALL law enforcement officers to identify themselves by last name & badge number. Police however need Reasonable Articulable Suspicion that a crime has been committed to detain a citizen. In States where there is a Stop & identify law you must simple give your NAME, you don't have to show ID or even carry ID. If you are driving and stopped it is different then a stop walking down the road and you must produce licence, registration & Insurance proof.

  • Actually according to the United States Supreme Court ruling in Wilson v. Arkansas, 514 US 927, 934 (1995) The Civil Rights Act among others REQUIRE law enforcement officers to identify themselves. Law enforcement is not allowed to operate as secret KGB type "officers".

    The Court also affirmed your Constitutional Rights to face your accuser in several rulings that apply to officers. So no we don't have secret police here in the United States, when we do it's time to shoot them on sight.

    I do however agree that in most location they must present upon request though though hours of searching I have yet to find such a law, yet, but there is no federal law regulating it, it would be left to the states to decide.

    Probable Cause: A reasonable belief that a person has committed a crime.

    Reasonable Suspicion:an objectively justifiable suspicion that is based on specific facts or circumstances and that justifies stopping and sometimes searching (as by frisking) a person thought to be involved in criminal activity at the time.

    Cop had neither, therefore no legal justification to stop the man behind the camera.

  • Yeah that was FDLE Capital Police. Their not the Police to be messing with. Their not as optimistic as other agencies. And as a LEO if they didn't pull you over or placing you with a crime they don't have to give you their name or badge number, that's a misconception that a lot of people have. It's a personal safety issue. If some one asks me I give it to them it's polite and shows courtesy.

  • While I agree with pressing cops to make sure they adhere to the same laws that govern the people they're sworn to protect... But the next time you guys decide to give something as "law" or "right" you should be prepared to back this up with the statute, or somewhere in the penal code which dictates what you're demanding.

  • They are't legally obligated to give you their name and badge number. Some police departments have a policy of giving the information when requested. I'd suggest trying to research your department's policies, but likely it isn't a requirement there at least in such an instance as this.

  • Actually, as public officials, the police are legally obligated to provide name and badge number when on duty. It's stated in their Patrol Guide/Public Contract. As long as an officer is acting as a public official they have to give name/badge number. Our tax money is paying them, after all.

  • A Patrol guide is not a legal document. It's a department policy. Not all departments have such policies. It also isn't typically black and white if they do have such a policy.
