Breyer believes in the rule of a man (a judge). Scalia believes in applying the law, as written, which represents millions of U.S citizens over the last 200+ years.

An intellectual conundrum that Scalia implicitly brings up is: what is the role of a supreme court or any judicial system when a democratic legislature is used for undemocratic or oppressive ends? or, rather, when a legislature, ridden with veto points, is unable to promote democratic ends?
