  • Sad, So sad that a great talent like Buddy would have to deal with that.

  • To a lot of people who don't know, this explains why a lot of Buddy Holly's songs were released as the "Crickets", not as "Buddy Holly", as you heard, he couldn't record and release any of his songs he did at Decca for 5 years, including That'll Be The Day. So technically and legally, That'll Be The Day was a "cover" done by the Crickets.

  • This is remarkable. I think one of the songs being discussed here is Thatll Be the Day. Which Holly did release on another label and Decca never objected. Wish who posted this would give us more info. Buddy was much more savvy then alot of you think.

  • @BillySnicker The five songs were "Girl On My Mind", "Rock Around With Ollie Vee", "I'm Changing All Those Changes", "Don't Come Back Knocking", and the original version of "That'll Be The Day". All five were eventually issued with several other Decca recordings by Holly, not long after Buddy (with the Crickets) had a hit with a new version of "...Day".

  • @LandondeeL That is, the album by Holly was issued by Decca. The title (of course) was THAT'LL BE THE DAY, it was later reissued as THE GREAT BUDDY HOLLY.

  • @thEannoyingE Yes a reel-to-reel recorder was used, with a special type of mike, attached to the reciever end of the phone with a suction cup, and plugged into the mike jack.

  • @SteveWallsable As I had already mentioed below, Decca would release a cash-in album with those 5 songs, along with 2 released singles and flip sides, along with 2 other previously unreleased Decca recordings, for a cash-in album THAT'LL BE THE DAY.

  • For those who hate Norman Petty, he was still Buddy's savior, regardlessly. He allowed Buddy the freedom he needed to make his own music. DECCA was incredibly harsh to Buddy, going as far as to say "That'll Be the Day" was the worst song ever. Thank God he got out of that.

  • Thats BS! Buddy should have had full rights to those recordings since it was HIS voice on those recordings. Legally, a persons voice on a recording is like their image in print. Nobody else has the rights to that image. The same with voice. He should have sued the pants off these damn parasites.

  • @coyclown It can't be that simple in the music business - if that was the case, every singer would own all of their own music just because it's their voice. And what about the other voices on the record - backup singers, etc.

  • Pulchrakia & coyclown - Laws for protecting artists have changed significantly since this time. It is unfortunate that Buddy along w/countless other artists had to be the martyrs of that battle. However, as both a musician and a businessman, I can see both sides. The idea then never was that artists would become independently wealthy, only the label, agent(s), etc. If they put up 100% of the risk in the cost of recording, promoting, etc, they should make 90% of the profit.

  • Witness the success of someone like Levi Strauss making money off of the gold miners to see how this works. A good businessman does not care about the dreams, just the profit. Buddy was actually smart enough to realize this too and that's what this call was all about. We hear a LOT of talk today about the evils of the wealthy and big business, but if the alternative is govt having all the rights and doling them out to us, the meek citizens as the "law" sees fit, that is the WRONG direction.

  • After this phone call Buddy went to Brunswick Records and re-recorded his songs his way , one being That'll Be The Day. Decca went to sue but guess what?.. Decca owned Brunswick. Buddy won.

    Buddy comes across as a real gentleman(which we all knew anyway) and cohen a total pr**k!

But here's the side of the story you don't know: In this call, Buddy is LYING HIS ASS OFF. He has ALREADY cut the NEW version of "That'll Be The Day," and Buddy secretly took it to Brunswick Records -- a SUBSIDIARY of Decca. Brunswick released it as a single almost immediately, and Decca COULDN'T SUE. Who would they sue? Themselves? Genius.

  • This is very much an aural snapshot of the times: Notice that Buddy had to place the call through a Long Distance Operator (area codes weren't in use then). Also, when Buddy gives his phone number, he uses an exchange, in this case "Porter". All-digit phone numbers weren't introduced as of yet either.

  • @picassoui You're thinking intellectual property right, copyright has to be filed.

    Truth of this matter is Cohen owned the tapes and the material that they contained. Charles Holley, on the other hand owned the intellectual property rights to any original material that appeared on the tapes. If Buddy had taken this to court he could have got an injunction against Decca releasing the tapes but he saved lawyer fees and had them released by a Decca subsidiary.

    Ma Holley didn't raise no fool.

  • The recording industry--then and now--has always been infested with Jew snakes like Cohen. The notorious Stan Polley was a classic example. His complete reaming of the '70s group Badfinger resulted in at least two suicides, and the band members becoming destitute. Holly was a classic good 'ol boy, and is in sharp contrast to Cohen here.

  • Thank god the new record "industry" has all but eliminated the fat white guys who stole from all these artists over the, oh, 80 previous years, ESPECIALLY the old blues and RnB guys, who routinely had their royalties stolen.
