  • This is what I hate. That security guard was overzelous, and thought that it was a crime to film. Is simply "private property" the reason you can't film? They don't want to tell you the real explanation and purpose of the policy? and if it appears like your just filming your family and friends, they should leave you alone. They can't just grab your camera. Why should I listen to a guard that is rude.

  • He actually has every right to take the camera. Private property. I am in that line of work as well. I would have just said to stop filming and told you where you could. Too much paperwork for a camera lol

  • Malls are private property with public access. The mall might have policies against filming. You could have asked permission and the mall management (in my experience) will usually grant that permission.

    Now, why do these security guards act like this? If there was a policy.. he could have simply explained the policy to you. Rather than essentially stealing your camera. Just because they are acting as agents of the property owner it does not give them the right to take away your camera.

  • I understand your frustration man i do. im with valor security. what he may have you were doing, was filming or taking still photosd of logos of the business's for a commercial reason. Usually if you just explain its a personal film and not for commercial use, you'll be just fine man. Also, unfortunatly he was very unprofessional and could have handled that in a better way.

  • most security are morons....i worked in security for several years....several different places. they pretend to be police but they usually have no clue about the laws ....state or local laws.....search and seizure...officer safety.....case law.....talking to people....etc....

    i got out of security cause i was tired of working with stupid people

  • Private Property versus Public Property. If a Security guard or Caretaker shows up to tell you what's what, it means that you're on Private Property. The only time a peace officer can remove something from your person is if they're detaining you and even then only if you're a danger to yourself or others. You're right, he can't take your camera and technically he can't take your skateboard either. That's considered theft.

  • Next time, calmly but firmly say, "The mall is opens itself to the public, reducing it's private property right to exclude. If you ask us to leave, we will. But you have no right to touch us or our property." If he does, assault his ass in defense of yourself and your property, just use reasonable force.

  • I film all the time in random places, and I was filming at the mall one time, mind you, I was not filming in any of the stores, just in the main hallway, no one else was in the frame except myself and my friend, and the guards went CRAZY. It was ridiculous.

  • @garrisonboobs I could tell just by the layout of the garage that this was Hillsdale. I guess then I could consider myself lucky that I squeezed in some videos there. But after seeing what happened to you guys I'm planning to stay away from that mall indefinitely.

  • you speaking as a "rent-a-cop" let alone my districts supervisor, I can tell you all, if they behave this way, demand to see their supervisor.

    I won't lie, I cant have skateboarding go on the property where I am, however as I have shown my officers a simple "Hey guys, I can't have ya skating here. move along please." is what I teach to be the best approach. No body likes to be an asshole, but property owners are afraid because if you hurt yourself, your parents can and will sue.

  • @soymilk43223 i totally understand. I always will leave if someone just says hey no skating please just as you said. i just found it weird that he wanted my camera and not the skateboard which was the whole reason for him going there and kicking us out.

    No of course he wanted the Camera, he knows what he did was in violation of his contract with the site owner (Security guards are NOT permitted to touch you, unless they are legally armed security.) He can ask for your name, and for you to move along. But in no way shape or form is he permitted to touch you, your property, nor may the guard detain you. I would re-post this video with the places name in it and link it everywhere to raise a stink.

  • @soymilk43223 Unless you are a lawyer, you should keep your mouth shut. A security guard as all the rights of a private person to effect an arrest if he witnesses a misdeamor or reasonably believes a felony has occurred.. That's under California Penal Code 837. Furthermore, a security guard is an AGENT of the owner of the property and thereby is legally authorized to enforce any legal rules and policies.. Hillsdale mall is a "Private property with OPEN access to the general public."

    Oh I assure you being in LAW SCHOOL, gives me some knowledge, and Cali Code 837 only is under statue of a Felony committed in a public place, and only by a Peace officer. Security guards do NOT have the right to take possessions belonging to a citizen, nor the right to detain unless an offense under code 837 (which skateboarding does not constitute.) Therefore, the guard opens up the mall, the owner and the guard himself to a lawsuit. Let alone the criminal charge of kidnapping.

  • @roymp870 I dont believe they have the right to take a camera, they can escort you off the property or call the real police but there is no law against photography, even if its prohibited in the mall they can only issue a trespassing order for it..

  • Many malls really don't want to be filmed--they require a permit for that (lol and, quite often, payment for that permit). Of course, since everyone has a camera on their phone, their rules are kind of stupid.
