It's not the length that's the main issue. It's whether the clips used are relevant to the criticism being offered. Whether the work in question is factual or creative, the potential market value of the work in question and whether the derivative work is a type of substitute product.

Without that policy, then noone would be able to report anything. Communication and reporting would become impossible. That's why fair-use exists.

If it is found to be false, the video will likely be allowed for re-posting by that individual. Many videos have been taken down from youtube based on false DMCA's uncontested.

'Fair Use' allows people to copy and use footage from other videos on YouTube for the purposes of "Comment, Criticism and Parody". Since drcraigvideos uploads this stuff, every other youtuber is at liberty to use it under fair use, this is why Tf00t's counter-notification will be successful.

It's not the length that's the main issue. It's whether the clips used are relevant to the criticism being offered. Whether the work in question is factual or creative, the potential market value of the work in question and whether the derivative work is a type of substitute product.

@smellyf00t1912 So basically, people can be fucked up in court for really short quotes of other people's work if those quotes somehow undermine significant market value of the original work, yet really long quotes can pass as entirely reasonable and necessary for commentary.
The main issue with your false analogy about a capture from a movie theater does of course have to do with economic aspect. That's just not relevant here, and you'd be laughed out of court going that route.

Internet reviewer's do this all the time and have NEVER been shut down for it. The only time anyone even raises a stink about it is when people like you file false DMCA's but they get quickly overturned due to lack of evidence that the material in question does NOT fall under fair use

@Earendur08 If you copy copyrighted material and make that your product, then yes. If you make an original documentary, like a news story or report, that includes bits of copyrighted material, then the fair-use policy applies.
Without that policy, then noone would be able to report anything. Communication and reporting would become impossible. That's why fair-use exists.
But yes, he can make money from the documentary he made.

That's exactly what fair use means. That what would be considered illegal normally is actually legal in certain cases. Specifically that you could 'steal' someone's work without permission legally. Though if your definition of steal implies illegal you would have to use a different word.
