I'd say it's a gopher snake but i'm not an expert I just looked it up online. they try to imitate rattlesnakes but a difference i saw is:

-Gopher snake tails taper to a thin tip and lack rattles; rattlesnake tails always have rattles (or immature buttons), unless the rattle has broken off.

although it's not poisonous, it could still be very dangerous so I'd call animal control or whatever you have to call to get it out of your yard.
