  • Maybe the owner should be forced to take pictures of each of the items on the menu so that all people of all languages can just point to what they want. No deviation from basic menu. Maybe the government would like to pay for those meals as well!

    I love going to the Department of Motor Vehicles. There are tests that are in 16 languages, but there should only be one: The same language that is on the signs, ENGLISH only. Mabye we should have the signs in 16 languages too. That will create jobs!

    I don't see how requiring others to be able to speak in a common language in order for trade to commence is that hard. Assuming the menu was in english, the customers needed to read what the menu said. Even if they can't pronounce it perfectly in the local accent, they could get it close. English and spanish use the same letters(ish) with same sounds(ish). Ish works well in a diner. How else do cajuns and texans trade with each other?

  • There are many American Citizens who are bilingual spanish/english. Wait until some of these individuals go into this restaurant and choose to speak spanish. Once they are refused service based on this idiot, their civil rights will be violated. Spanish was spoken on this land long before white people invaded and forced people to speak english. A simple solution would be for this man to hire a bilingual employee. But when you are backwards thinking like most closet racists, they r too dumb

  • @takethetimetoday Are you aware that the owner of a business can refuse anyone service, for any reason. Just like you can deny anyone entrance into your house. I think you misunderstand how property rights work. Also, no one has a civil right to eat in a restaurant.

Private businesses, such as country clubs and golf courses, CAN utilize statetments of right to determine whom they will offer business to. check the law before you comment and demonstrate your ignorance, please.

Not speaking a language, being ugly, the owner just disliking you, none are illegal grounds for refusal of service. I read the Act too. It's his restaurant and, as long as he doesn't use force, he can refuse service to whoever he chooses.

The scientific distinctions of race were linguistically-based. The distinctions were not biological. The division of the races is based in linguistic origin, not physical genetics. Law usually relies on the denotation of words, not connotation. Any good lawyer can prove what takethetimetoday has said. It can not serve by membership.

  • @Jcuel2 In 21st century America, "race" refers to the physical characteristics of an individual. What you should argue for is discrimination on the basis of national origin. Language is not racial, it's cultural. Further, Title II of the Civil Rights Act simply limits the reasons for unequal access to a public business. Can the owner throw out non-English speaking people? If he has a business necessity reason, you bet he can. Use a law book, not wikipedia, to reason this out.

  • Respond to this video... Race is a distinction of linguistics if we're talking about OFFICIAL ENGLISH here. Look closely again at what you quote: "discrimination or segregation on the ground of race, color, religion, or national origin." Again, our written law is known for using exact denotation of words, not connotation.

  • @Jcuel2 Language has nothing to do with race. Race is about the color of a person's skin or their physical characteristics. Check it, suppose there's a Hispanic person who only speaks Mandarin, he could be adopted. If he puts "Hispanic" on a job application, and then is denied the job, is it because he was Chinese? Language is cultural, race is physical. One is learned, the other is a product of biology.

I explained how discriminating against someone because they do not speak English could be construed as a violation of the bill according to its own language and usage of the word race. Race difference can legally be construed as meaning a language difference. This can easily be argued by any competent lawyer citing the language of the bill itself. The word race in context here can easily double for language.

Everyone on Earth today is the same exact biological species or race. The separate families of man have been categorized primarily by language and region of origin. The Civil Rights Act isn't there for Neanderthals, they're all dead, they don't need civil rights. It's there so no one can put up signs that say "Whites only". Discrimination is about irrational hatred, keyword "irrational". The restaurant guy just couldn't accommodate anyone who didn't speak English.

ANY "[ ___ ] only" sign would constitute a prerequisite for service. A public service can not cater by membership. A language requirement is most certainly a CLEAR violation of this bill. You are aware of the fact that the USA does not have a declared official language, right?

  • @Jcuel2 I don't know if you have access to this or not, but check out Garcia v. Spun Steak Co. 998 F.2d 1480 (9th Cir. 1993). In the case, Spun Steak was sued by two employees who only spoke Spanish, after it instituted an English-only policy. The judge found that Spun Steak had not violated the Civil Rights Act and dismissed the employees claim. It is a slightly different scenario, but I think it illustrates the point.

The need to take it to the extreme like you did to include all languages is nothing but a cognitive distortion where a person sees a scenario in an either/or frame of reference. Oh, and by the way, Spanish is spoken by more individuals in America other than English, so yes, hiring someone who speaks Spanish works.

  • @JohnQPerson I lived in Japan for 6 years. I'm an American. I learned enough of the language to order in restaurants. Lots of smiling and pointing are very helpful. You've gotta be pretty stupid to be unable to point at a menu, the dish someone else is eating, or a picture on the wall. Also, the guy said the customers were being verbally abusive, that's not cool in any language.

Two weeks ago a good friend was yet ANOTHER statistic of an illegal driving without insurance or a license and totaled her car. Naturally he tried to escape on foot but was run down.   • @darrenritt27 Yes there is such a thing as American English. American English differs from British English or from those of the "English ethnicity". For example in America we have " Color ". In the U.K it would be spelled as " Colour ". There is also the obvious differences in accent.

I doubt that this guy would refuse someone with a British accent because they didnt speak "American English". Whats really messed up is how some people in this country with accents are harder to understand than foreigners.

    It has always pissed us off in Canada when we get people that are new to Canada that seem to not try to learn English.I remember working in a factory and trying to train immigrants how to do their job and they didn't know any English.What a pain in the ass.Many of us feel that they should have to learn English before they come here.I also doubt if this guy would refuse an English speaking Canadian or British or Australian etc.

    Yet I do not.Part of the reason is that I have always had to convert back and forth.The other part is that I have chosen to hate the metric system even though people say it is much easier.The only metric I have every learned is the stuff I have had to learn like kilometer per hour.I still use feet,inches,pounds.I am not the only Canadian like that.The younger generation only knows metric.

Ive met plenty of foreigners who speak english as a second language who are easy to understand accent and all. Ive also met plenty of hicks who only speak English that i cant understand.
