  • That's assult. They have no right to detain you unless proforming a citizens arrest. If security try to stop you all you have to do is walk past them, they can not lay a finger on you. And remember people when in trouble with security all you have to say is " Not disproportionate to the objective" that's what they are taught in their training, andthey will think twice about what actions they will take.

    Yes, I also thought this to be unlawful. Australia seems to have all the trappings of a "first world", "developed" country with all sorts of laws and institutions protecting private citizens, (like the "Anti-Discrimination Board") but very few of them actually have teeth.

    Pardon me for being critical of Australia while actually living here, but without such critical observation and discussion, life in Australia will sink even lower can only sink lower.

  • @DontPublicMe A store security guard has the right to detain a person untill the Police arrive. It saves the Police having to search and find the criminal later on, doing so would be a waste of Police time and resources. Store security guards also reserve the right to chase a suspect who runs out of the store, that's their job. However, in this case, they should of sent the women into a room or something, it's not good to detain a suspect in the middle of the store.

If it was illegal for security guys to detain an offender, than the police would of had a go at them. But it's not illegal, they do it all the time.

  • @ramseytawil Thats not true. Any citizen is justified in using reasonable force to restrain someone they assume has commited an offence. Covered in section 35 of the Crimes Act 1961.

Exactly the same kind of power you have if someone is on your property and committing a criminal offense, you have a right to restrain them as an absolute minimum. It's the same law. The key word in section 35 of the Crimes Act is 'reasonable force'. And what's 'reasonable' to you may not be reasonable to a judge to a burglar etc. It's subjective :-)

    The security guard 'assumed' the lady had the intent to permanently deprive the shop, therefore she was assumed to at least be in the process of committing a crime and as such the guard is allowed to use reasonable force to detain her.

    If it went to court, which I'd doubt, she could have a sound defense though.
