The problem with Executive Order 09-05 was that it WAS an executive order. In July, 2010 Evergreen Freedom Foundation sued the governor for overstepping her constitutional boundaries, since order 09-05 was formerly, a Senate bill (senate bill 5735). The bill was voted on and failed. According to the state constitution, a failed bill is not legally binding.
@Sparkygravity I'm a conservationist myself but I respect the rule of law, and the purposes of checks and balances enough to be wary when civil servants enact law by mandate and not due process. It makes me question their agendas. You might be happy to know that the Thurston County Supreme Court overturned the lawsuit stating that the executive order was not legally binding, it was simply a directive to state agencies, and that as such she did not overstep her constitutional authority.
