Don't protest without a permit where you are required a permit (by laws created by bodies institutionalized by the Constitution) and you won't get arrested. This is a very simple concept.
First, the District of Columbia does not require a permit if you have less than 25 people. That was the case here, as this demonstration had less than 25.
Secondly, you can NEVER demonstrate on the steps of the Supreme Court. Demonstrations must be held on the sidewalk at the bottom of the steps, no exceptions.
Lastly, this was a deliberate act of civil disobedience. Getting arrested was explicitly the point of the act.
