Yes, your overfilling of gas happens when the petrol expands with the heat. While the petrol is underground it's relatively cold. This is why you stop and go to the bathroom or to get something to eat BEFORE you fill.

When you fill to the brim you best be getting on your way 'else you're wasting precious dinosaur juice! (and also it's a fire hazard)
