Only takes a second to load a gun, only takes a second for criminal with a LOADED gun to victimize you. My point had nothing to do with taking someones life, its more that a criminal knows your openly displayed firearm is UNLOADED. Average human can travel 7 yards in something like 2 seconds and knife your throat out.. Look it up, 21 foot rule.

Simply stating that "oh you can load a gun in xxx seconds" is completely useless argument. By the time you've identified a threat it's too late to load the gun! Why do you think police carry loaded guns? Common sense says that someone who is visibly armed isn't a 'safe' target, but that's assuming an assailant uses common sense.

  • @elesjuan what makes the criminal know anything, you can carry an unloaded gun and still carry a loaded one. you can carry an unloaded gun and still hold a knife, what you don't seem to understand is that criminals go for the easy target, the target carrying the gun isn't one. it's the one that can't defend themselves, the one carrying the gun can obviously defend themselves. it doesn't matter if it's loaded, he can have a knife in store or a ccw too. btw i didn't make that argument.

  • Its great that you exercise your right as I do, HOWEVER, try not to be so nervous, it makes them nervous, dont tell them not to follow you, that makes them suspicious, dont act SNOODY like its your right and not theirs to take. Cooperate with the officers in blue, most of them are good, and would be happy to see you on your way. If I am open carry and an officer happens to ask me questions I do not mind and answer the questions. Open carry in California is just asking to be questioned. Open carry with an unloaded weapon/gun is just plain stupid.

We don't have any type of open or concealed carry here in Canada (although the law permits concealed carry, nobody can get the permit) but if I did have this permit, I would have no problem talking to LEO's to confirm I am licenced. Or leave PRIVATE PROPERTY where the owner has asked you to leave because you have made his customers uncomfortable.

  • @realworldguninfo That is a good saying. I'd like to just point out that I am not "anti-gun" or anything like that. I target shoot and make sure when going to the range I have all documentation ready to present to an LEO if requested. Because it is illegal to have a firearm without a licence + registration + transport permit for certain weapons ... they rightfully can and do ask to see this documents.

    Don't OC within 1000' of a K-12 school or in a govn't building.Loaded mags or speedloaders visable on the belt.The Mag is considered part of the gun.Loose rounds in your pocket are OK.Unloaded unless where discharge is legal. I do realize that if he didn't leave when requested to do so that he could be arrested for trespassing - thankfully he left. However, I've always been under the notion that if you don't use your rights, then you will lose them. I don't see a problem in exercising your rights. If you're saying people shouldn't OC, so they don't ban it - then what's the difference of not doing it or banning it? Either way you aren't doing it.

So you've never been stopped and hassled or had an officer perform an e-check on your weapon when you were in Cali? I'm from VA and I see open carry often and it never seems to create a stir.     You cannot OC without "showboating"... when you OC your gun is out in the open and it's a dice-roll on whether or not you will be harassed, thus you have to "showboat" in regards to defending your right to OC.

  • @diginit3 You're argument over OC'ing a long rifle makes sense that it may have damaged the right to OC. That's not the point.

    The point is that even when you OC a pistol, people are afraid and it causes problems regardless of whether or not it's a rifle.

    OCing a rifle, while yes it's not necessary, is about demonstrating your rights. It opens people eyes and both practicing your rights, and opening others eyes to their rights is absolutely necessary in regards to protecting your rights.

    The government is no longer in place to protect your rights, but more so to figure out ways in which to remove them.

    There is no "demand" in regards to OC'ing. OC'ing is a right. When government forcibly removes rights that they have no right to infringe upon, you make demands. If the government isn't polite regarding infringement of rights, why would the right bearers be polite?

    The point is the man was unlawfully detained. If the management wanted him to leave the cops should have merely asked him to leave. Instead the cops detained and searched the open carrier without RAS or PC of criminal activity. Then they approached the management and compelled the manager to agree that the carrier should leave.

  • @toptruckracer wrong, open carry in itself is grounds for detention, ask the guy in the video, he will tell you. law enforcement can detain and inspect the weapon. Most people that are familiar with open carry are aware of that, including the guy here. But whatever I dont really care, go make a complaint and see where it gets. I guess you would rather the cops not respond to the call at all.

    The exercise of a fundamental right is not subject to a detention without reasonable suspicion of a crime. US v Umbiles, Terry v Ohio, Florida v JL. The problem with checks is that they are illegal searches because there is no RAS that a crime has, is, or will occur. It is an illegal or unconstitutional law.

    Manager and employees can conceal/open carry un/loaded on premises no permit needed. Manager is probably prohibited by corporate from carrying.

    Also, I ask about race of MGR and OCW? MGR looked Latino, and now he has 4 big cops there he gets brave enough to ask customer to go.

The police showed up, used their discretion in enforcing an optional and constitutionally questionable California law to check the status of his weapon, determined it was unloaded, and continued to detain him and harass him. They coerced the manager into asking him to leave. If the police talk a store manager into asking you to leave, how is that not harassment?
