  • Lets get something straight, this is NOT government take over, it is oversight that allows for all Americans to afford health care. 1976 Hyde Amendment remains; so no public funded abortions.

    Remember repeal would mean a 2/3rd vote in both houses of congress, not likely to happen. It would require a 26 seat change in the Senate and nearly 130 seat change in the house. This has never happened. By 2012, the wind in the sails for the GOP will be gone from this issue.

  • @aeuiono 2/3rd would be required to be veto proof. Otherwise they (a new congress) would have to wait until 2013 for either a change in the WH or pick up more seats. Most GOP members are being very disingenuous running on this platform in order to raise money. Even then by 2013, some of the more popular items in the bill will be harder to remove.

The 10th amendment is not what you think it is and unfortunately as my original stance goes, it is disingenuous for GOP candidates and incumbents to raise money for something they know they will not likely have a chance of doing this coming midterm. If they tried to block funding it would stop Medicare altogether. You might cheer that, but many seniors would not.

    Repealing Obamacare would also mean repealing its Medicare cuts. Besides, seniors know we're broke.

  • @aeuiono Yes I do understand the constitution. Let me explain. While both amendments speak of state sovereign issues they do so in a way that does not supersede the US constitution. The 9th recognizes that there are rights that were simply not mentioned (previous amendments) these unenumerated rights are no less important than enumerated ones. 10th: limited to those granted in the Constitution and thus states may exercise its authority even in areas where the federal government may not.

    And how the federal government can pass legislation to give themselves and the IRS authority in health insurance, which is nowhere to be found in the enumerated powers of Article 1, Section 8, and thus a violation of the Tenth Amendment.

    Also, isn't Congress's own exemption from the exchange a violation of Article 4, Section 2?

  • @aeuiono Again, rights cannot supersede constitutional rights. In passing the Health Bill into law, it makes Health Care a right. As with your right to security within the US borders there is a cost. So if you think you are being denied your rights NOT to buy insurance then you must be an advocate for Federal government to pay your way. The 16th amendment provides power to the IRS. Very few people will be in the Health Care exchanges, most will get it through their employer

    Just because Congress passes legislation and the President signs it, it doesn't make it part of the Constitution.

    The passage of the bill via nuclear option even violated Congress's own rules. It didn't get a two-thirds majority in both houses

    We have the 2nd amendment right to arms, does that mean the government should force us all to buy a gun?

    We have the right to remain silent, does that mean the IRS can fine us for talking?

  • @aeuiono you are right it is not part of the constitution, however when bills are signed into law, they become constitutional. The Health Care bill was NOT passed via the "Nuclear Option" which would require changing the senate and house rules, they used a rule called reconciliation. Given that both bill were previously passed with a 2/3rd majority, the fixes deemed necessary by the CBO, only required a simple majority based on the rules. Read the 2nd and 5th amendment, you are way off base.

  • @aeuiono The Health Care reform is law, it is constitutional without making any changes to the constitution. It is not a big game changer in our country other than now you have access to affordable health care and health care providers are now guaranteed payment for services. More importantly it allows beneficial entitlement programs like Medicare to be viable up to at least 2050.

    Just because a law is passed and signed doesn't make it constitutional. You've probably never heard of US v. Butler, in which the SCOTUS ruled that the Agricultural Adjustment Act violated the Tenth Amendment for invading the rights of the states and going beyond the enumerated powers, but this case will be relevant when the Court rules insurance reform unconstitutional as well.

  • @aeuiono I will continue to vote... and yes the law is constitutional, I am informed enough to know that much. I may not be familiar with every High Court case, so until the court rules otherwise, Health Care reform is the law, however aspects of it will be phased in over time. I would suggest if you want it challenged, start your court proceedings now, it may take some time but you have that as a constitutional right.

    Yes, they are two separate things, but the Democrats didn't use just reconciliation, as pure reconciliation can only be used on budget bills. The Dems used the nuclear option to reinterpret the reconciliation rule, and even violated the Byrd rule. Insurance reform didn't pass the House with a 2/3 majority.

    Signing a bill into law doesn't make it constitutional. If you don't understand that, don't vote anymore.

  • @aeuiono sorry, they they did not change the rules. If you recall both houses had already passed their respective bills by a 2/3rd majority. The congressional Parliamentarian allowed for reconciliation rule to deal with the fixes to the Senate bill which under rules allowed for budgetary fixes (CBO recommended) and did not affect Social Security. If you had watched the debate, GOP members did not argue process rather they challenged substance. It was all w/in the rules.

  • @aeuiono At least this law (entitlements as you call it) is paid for unlike the GOP tax cuts (2 - wealthy citizens entitlements), wars (2-defense contractor entitlements), and Modernization of Medicare (drug company entitlement). 180 days from now many of the popular parts will be implemented and will be hard for congress of any stripe to repeal. I will give you this, it will take courage for future congresses to not continue to kick the financial can down the road.

  • I'm from Jordan's district. I supported the health care reform bill, and I think his reaction to it is disgraceful. Jim Jordan enjoys government-run health care for himself and his family. That's hypocritical. He says we can't trust government officials - HE IS a government official! Is he saying we can't trust him? Look at everything in our country that's made better/safer through govt. regulation: electricity, water, public airwaves, gas prices, food, medicine, roads, and on and on.

  • When President Obama struck a deal with pro-life Democrats and agreed to sign an Executive Order on the abortion funding issue, this did nothing to fix the fatally-flawed legislation that was approved. An Executive Order does not trump law. The legislation approved - the legislation that will be signed into law - does fund abortion. And that is what will ultimately be what controls health care - not the Executive Order.

  • Health Insurances companies stopped treating people honestly about 10 years ago. They will violate their own policies rather than payout for catastrophic care, knowing that many are likely to die during the appeal process. It doesn't do you any good to win the appeal when you have been denied critical care for months/years. Their lobby was strong enough to keep Single Payer out of play, so everyone relax...the status quo hasn't moved much for the vast majority.

  • You have no clue to what you just said. The Insurance industry is the most heavily regulated industry in the US. Every State has the own commission of Insurance. If a Insurance company violates state or federal law they can be put out of business immediately.

    As for "death panels", you're right, there's no death panels, just a "Comparative Effectiveness Center" which will "conduct research" into the "appropriateness of health services" in regards to "economics" (page 1557).

    A.K.A., a panel rationing everyone's care, deciding who-gets-what meds, if any, & choosing who lives or not.

  • healthcare, like any other service that has ever existed, is always going to be rationed in some way by someone. i don't see the benefit of letting private insurance versus political bureaucracy making the decision. neither seem a hundred percent ideal, either system could work or fail. it all depends. with the U.S. government, as a citizen, you get to control it collectively. with private you control by who you buy.

    so i don't get the point of getting all hyped. just two systems.

  • No i haven't read the whole bill. I don't know anyone who has. That's why I'm not for or against it at the moment. No one even argues on what is in or not in the bill, THAT'S MY WHOLE POINT. The CBO projects that in 2020 our debt will be 90% of GDP. I'll take your word for it. But the CBO also made a preliminary projection that this bill would cut the deficit by $138 billion over the next 10 years.

    Fuck the Al Sharpton quote, that's nonsense. Talk numbers, facts not emotion.

    The CBO can only project based on what Congress gives it. The CBO didn't factor in the doc fix.

    They were then asked what would happen when all parts of the legislation were factored in, and the CBO projected it would "add $59 billion to budget deficits over the 2010-2019 period."

    Furthermore, the CBO said that Obamacare will result in at least $109 billion in new deficit spending over the next 10 years.

    Besides I don't want the US to have a healthcare system that is more like Canada. Douglas was rated the greatest Canadian ever for us because he brought national healthcare, a cornerstone in our Canadian identity..the US can't copy us now...

    Keep the US old system..even if it doesn't cover 10%, costs double ours per capita, and has a lower life expectancy.
