Free exchange or peer to peer file swapping is the same as a song on the radio and is really a free ad. Only if money is changing hands for the music then that = infringement. E.g. copyright protection was originally 14 years and now it's 100+ years. That never would've passed originally because the purpose was only to protect works long enough to be incentive to create and publish new works SO they could enter the public domain, but now people seem to think perpetual ownership of concepts is reasonable.

Very rarely does it go to court, they need to prove you downloaded it personally and your I.P. was not used by someone else. You need to do more research, Google "davenport lyons" and you will see they handed out law suits to over 30K people (me included) and they never took a single one of them to court. The only time it goes to court is when someone admits guilt. In short your legal summary is wrong.
