As of January 2009, 520 detainees had been released from Gitmo during Bush's presidency. According to the DoD the same month, 18 were confirmed returned to the battlefield and 43 suspected. At worst that's a recidivism rate of 12%.
As usual the DoD didn't share how it arrived at these numbers, but it's been reported that simply making anti-American statements to the media can get a former detainee on the list.
The latest number, 1 in 7, is 14%. That figure also includes a lot of "suspecteds".

DoD has no way to track POW's once they are released from detention nor would they bother tracking them since our assests are divided on two fronts.

So it was not a crime because technically torture was not committed within the boundaries of USA. Cheney and others knew that one day they would be prosecuted for this, long before they did the war.
The only reason Gitmo was established was because it was not US soil so that torture would not be illegal. The goal of selecting that location was primarily was torturing without seemingly breaking the law of the USA. That was the idea suggested and defended by Law Professor Alan Dershowitz on National Television- I watched- sometime before the war, before the first prisoners arrived.

As of January 2009, 520 detainees had been released from Gitmo during Bush's presidency. According to the DoD the same month, 18 were confirmed returned to the battlefield and 43 suspected. At worst that's a recidivism rate of 12%.
As usual the DoD didn't share how it arrived at these numbers, but it's been reported that simply making anti-American statements to the media can get a former detainee on the list.
The latest number, 1 in 7, is 14%. That figure also includes a lot of "suspecteds".

It's unlikely that the prosecutors would be able to use all the evidence against them because it wasn't gathered with an eye to its admissibility in a criminal trial. The very concept of trying terrorists under US law is a slippery slope. We specifically allow our military and intelligence operatives to proceed without the procedural safeguards enumerated in the Fourth, Fifth and Sixth amendments. Why? Because we didn't plan for trials in civilian courts, we didn't take care to see that the evidence was obtained so as to be admissible in civilian courts.

Bringing the terrorists to the US puts us at risk that they could be freed by court order.
Some detainees will be tried in US courts on US soil. The first will be tried in New York.
This raises two problems: First, if he is acquitted, where will he be released? Likely, he'll just be invited to walk out the door and onto the streets of New York. Second, is there a danger of terrorist retaliation or attempts to interdict the trial with violence?

Obama is attacking a red herring when he defends his decision to send the worst terrorists at Gitmo to US prisons by saying the likelihood of escape from secure federal facilities is very low. But when it comes to federal judges, we can't be so sure.
We sent the terrorists to Gitmo rather than bring them onto US soil since Bush feared, quite correctly, that if the inmates were in federal prisons on US territory, federal judges would take their pleas for constitutional rights more seriously.

So it was not a crime because technically torture was not committed within the boundaries of USA. Cheney and others knew that one day they would be prosecuted for this, long before they did the war.

The only reason Gitmo was established was because it was not US soil so that torture would not be illegal. The goal of selecting that location was primarily was torturing without seemingly breaking the law of the USA. That was the idea suggested and defended by Law Professor Alan Dershowitz on National Television- I watched- sometime before the war, before the first prisoners arrived.

That's right, you don't grant habeas corpus to terrorists at Gitmo or Bagram, because we have no way of trying these people. Our courts aren't set up for these kinds of trials, which is why they are being held in indefinite detention.
