I recently saw the episode where NBC flew David Goldman to Rio to pick up Sean. Obviously David Goldman has been screwed over by big money. I have seen the whole story and agree that Sean was abducted and his mom's family used the court system to keep David from his kid.
However, the boy is more Brazillian than American and he's going to go through a very heavy transition in New Jersey. Such a shame for everyone and his mom is to blame

When I was in Brazil I found that things in govt move very slowly compared to the USA. But that's Brazil. The people are wonderful and I loved being there.

I am very happy that David and Sean Goldman are reunited! It was Sean's mother's FAULT because she took Sean with her to Brazil for vacation, she lied to David, relatives and friends. She should tell David that she wants a divorce first and should sit down and discuss about Sean for the future. David was being HURT for 5 years like Sean was being HURT from his other family in Brazil. It was all Sean's mother's damn fault!!!! I am very happy that they reunited and will adjust fast!
It was about time justice was done! Those power hungry officials got me stuck there with my 17 yr old daughter last summer. They didn't accept the paper work from US saying I had sole custody. They said American papers don't mean anything to them. They determined my authorization was expired even though it had no expiration date. We lost our return ticket, my daughter and I had problems at work and school. They didn't even care if we had money to stay longer. They are power hungry!

No - The "kidnapping" was wrong, but it was not the same as "kidnapping" in the Patricia Hearst sense of the word as he was taken to Brazil by his biological mother who was re-married. To assume that a real loving relationship did not develop between the step father and Sean and his sister,Grandmother,uncles, whoever, is not reasonable either. I do not believe that the way Sean ended up where he is was right, but that does not take away the fact that he has developed a life and loves there too.

You brought up good things to ponder. But these complicated issues are the end results for dragging it by all people involved in the last 5 yrs. If it were resolved right away, it would have been easier for all especially for the child. And that's why there are laws, so that we all know what our rights and what to expect. But the adults, especially the mother in this case, were too selfish to just think of what they want and not what is good for the child.
Kipptumor, here's a dilemma to think about. If the child were to stay with his maternal relatives due to all the reasons you mentioned, then there is nothing (not even any kind of law) to discourage any similar behavior/action that this mother took. And without any law to to discourage such behavior, then we will find more cases ending up the same way as this case did, and we will find more children in this predicament.
The vast majority of Brazilians supported David, except for a few(and I mean FEW) would think he should stay with his Brazlian family. They´re all in favour of David. I read many posts in portuguese, They were all congratulating David for having his son back. And even insulting Bruna´s family. I could only find about 2 or 3 comments that were in favour of Sean staying in Brazil. And they weren´t so rigorous, just thinking that he´s already adapeted to them and...

@fccxyz This wasn´t so much on tv in Brazil as it was in the States. Now that it was more commented on tv, people became more aware. So now, the great majority understood the case and are in favour of Sean remaning with his father.

Culturally yes he is American and Brazilian. However he was born in the United States and that supersedes Brazil law. His father is here, he was born here, his father has the right to have him. Now if he was born in Brazil, moved to the US, and then his mother went back to Brazil with sean 5 years ago then it would be a different story.

Let´s supose Bruna had done everything right(which she didn´t) from the beggining: if she didn´t like David anymore, she would have asked for a divorce while she was still in the US. And then the court would decide who had the right of custody of the son. According to Brazilian law, usually the mother has priority. I believe in the US must be the same. Then probably the rule could have gone in favour of Bruna. And maybe she could have broght him legally to Brazil.

Actually, that´s David´s version of the story. In another interview for the Brazilian tv, his grandmother said that everything David sent to him was given to him, and they showed all the letters and cards David sent t him during a conference. The exception(acording to her) was a package with many toys a a birthday card that were sent, and when it arrived they were traveling, and usually when a package like that arrives from abroad, you gotta go take it at the post office.
And if u don´t .go take then it returns to the sender. This is true(about the post office), although I don´t know if they´re saying the truth. Actually I don´t trust them very much, and most of their acts were done orientated by lawyers. So I don´t know if some of the things they said about David are true or not. I haven't seen anything that actually states that "the citizens of Brazil actually caused this." But what I find disturbing is the lack of reporting on the other family.
Who are they? What is their opinion? Why isn't there any cooperation between Goldman and the mom's family?
The reporting is not balanced. We have the mom's family as the rich culprits and David Goldman as the victim. Meanwhile people are forming their opinions based on unbalanced reporting.

I am very happy that David and Sean Goldman are reunited! It was Sean's mother's FAULT because she took Sean with her to Brazil for vacation, she lied to David, relatives and friends. She should tell David that she wants a divorce first and should sit down and discuss about Sean for the future. David was being HURT for 5 years like Sean was being HURT from his other family in Brazil. It was all Sean's mother's damn fault!!!! I am very happy that they reunited and will adjust fast!

It was about time justice was done! Those power hungry officials got me stuck there with my 17 yr old daughter last summer. They didn't accept the paper work from US saying I had sole custody. They said American papers don't mean anything to them. They determined my authorization was expired even though it had no expiration date. We lost our return ticket, my daughter and I had problems at work and school. They didn't even care if we had money to stay longer. They are power hungry!

Kidnapped or not, it seems nobody cares what Sean himself wants. Granted he is only nine, but he has formed a bond with the family in Brazil no matter how he ended up there in the first place. Now that he has been reunited with his father the psychiatrists are only now coming out of the woodwork reminding the world that this is going to be a very difficult adjustment for Sean. He knows very little English and has lived most of his life in Brazil. I hope this is really what is best for him.

No - The "kidnapping" was wrong, but it was not the same as "kidnapping" in the Patricia Hearst sense of the word as he was taken to Brazil by his biological mother who was re-married. To assume that a real loving relationship did not develop between the step father and Sean and his sister,Grandmother,uncles, whoever, is not reasonable either. I do not believe that the way Sean ended up where he is was right, but that does not take away the fact that he has developed a life and loves there too.

I'm just saying I hope some real thought has been given to how Sean sees this whole situation. I don't think there has been any concern or talk of his point of view. I don't think I qualify as an "ass" for asking this question. I'm not condoning the kidnapping, but right or wrong, Sean Goldman has a real family in Brazil I am sure, unless there has been some sort of starvation or beating we are not aware of. He HAS spent most of his life in Brazil & the change may be traumatic for him.

Atlhouhg slow, time and again, the court found in favor of the biological father. I wonder what Justice Marco Aurelio Mello is saying now. Did he say anything more on why we put a stay?
And I bet they (Lins e Silva and the Bianchis) were dragging this case until Sean turns 12, at which point they hope that he can testify and opt to stay in Brazil.

I just know that uprooting a child is traumatic at that age - Like I said - I don't think the method that he was taken there was right at all, but it has placed him in a family as far as we know. You brought up good things to ponder. But these complicated issues are the end results for dragging it by all people involved in the last 5 yrs. If it were resolved right away, it would have been easier for all especially for the child. And that's why there are laws, so that we all know what our rights and what to expect. But the adults, especially the mother in this case, were too selfish to just think of what they want and not what is good for the child.

If the child were to stay with his maternal relatives due to all the reasons you mentioned, then there is nothing (not even any kind of law) to discourage any similar behavior/action that this mother took. And without any law to to discourage such behavior, then we will find more cases ending up the same way as this case did, and we will find more children in this predicament.

The vast majority of Brazilians supported David, except for a few(and I mean FEW) would think he should stay with his Brazlian family. They´re all in favour of David. I read many posts in portuguese, They were all congratulating David for having his son back. And even insulting Bruna´s family. Let´s supose Bruna had done everything right(which she didn´t) from the beggining: if she didn´t like David anymore, she would have asked for a divorce while she was still in the US. And then the court would decide who had the right of custody of the son. According to Brazilian law, usually the mother has priority. I believe in the US must be the same. Then probably the rule could have gone in favour of Bruna. And maybe she could have broght him legally to Brazil.

Actually, that´s David´s version of the story. In another interview for the Brazilian tv, his grandmother said that everything David sent to him was given to him, and they showed all the letters and cards David sent t him during a conference. The exception(acording to her) was a package with many toys a a birthday card that were sent, and when it arrived they were traveling, and usually when a package like that arrives from abroad, you gotta go take it at the post office.

Im Brazilian and id like to say that our government is not ignoring any law or treaty on this case. Every brazilian court decision on this issue was favoring the return of Sean to his father. What is taking so long is that the stepfather's lawyer is putting every kind of bumps he can in the justice system to win time. The brazilian justice system cant ignore its own appealing laws. No we´re not ignoring them. You have to understand that the judicial system in Brazil is not the same as in USA. Things here run slower because of an excess of appealing rights. I agree that this can be very irritating, and i think we should restrict those laws too, but if it's todays law, it shall be respected and judges cant simply ignore them. About your government taking Elian Gonzales at gunpoint, well, all i have to say is that this is not how things are legally done here.

The kid is under the age of 13 so he can't testify and his "want" is not a direct reflection of his best interests. He is too young to know best, he has been brainwashed for five years by two kidnappers who shacked up and got married. The mother abducted the boy from the U.S., then remarried, but that does NOT make the new husband the "stepfather" unless he legally adopted the kid, which he CANNOT do because the boy's FATHER never gave the boy up to BE adopted by this man.

I am seriously concerned that Sean may actually enjoy his life in Brazil, and if that were the truth (I don't know though) I seriously doubt that, at this point, David would "do the right thing" and let Sean stay there - even if he has grown to love his family in Brazil. Even if he were better off there, but like I said - I don't know if he is happy there or if he is being abused by the Brazilian family in any way. What IF Sean wants to stay? Then what?

I think that it may actually do more damage to remove the kid from the world he has known for the majority of his lifetime so far. Is the Brazilian family, starving, beating, or abusing him in any way? I think David Goldman, if given the knowledge that perhaps it would be in his son's best interest to let him stay in Brazil or take him to New Jersey, he would still choose to take him because he has abandoned what may be in the best interest of the child for a vendetta now.
