now, while I am not a fan of stealing, that thing is cool. I would propose allowing the city to keep the monster(donate it to the local Museum), fine the guy the amount of the barrels and some community service(making more barrel monsters maybe). the monster is cool as hell, but I want the guy tried and convicted because I know in the south Construction crews are known to work at night and the last thing we need is someone getting mowed over because of this guys love of barrel monster.

Maybe he just wanted his work seen. He does good work. If he did cost money, then make him pay. But he wasn't hurting anyone and he did a great job.

Do I need to explain the concept of theft and destruction of private property? The barrels were private property that he stole. It's exactly the same as stealing a car. The question isn't if it's art, but do the police have a right to charge him. The creation of an "art" piece does not nullify the crime, it's not a defense. "Yes, your honor my client did kill a man but the body was then displayed as a piece of art."
I use extreme examples. I'm trying to get you to open your mind and think.

no its not the same, barrels arent worth as much as a car, and depending on the value of the item(s) is how long you will be incarcerated or on how much the fine is.

Of course the amount you have to pay for your depends on how much you stole. That's not the point though. Did he commit a crime- YES. It doesn't matter that you like the sculpture. My roommates TV was stolen. He ended up getting a nicer one for free from his insurance. Because he liked the out come doesn't make the guy that took it any less of a criminal.

If he took them from a job site than he was endagering the life/ safety of all the motorists and workers. If someone had died in an accident he could have been liable and sent to prison for a long time. Also if they were at a job site then they were being rented at the expense of the local jurisdiction. Jimmy, you are very narrow minded in your thinking on this one.

The company that made the barrels didn't want to press any charges. They didn't interfere with anything. They actually wanted to hire him for advertising. So I think YOU shouldn't be so narrow minded when all your knowledge is coming from a 4 and a half minute video. I live in Raleigh were this happened and i probably know more than you about it.

Yes it does, people who kill people for justice, are praised by people, like superheroes, they arent arrested, they arent even talked to about his many murders, yet people who kill people for no reason are considered monsters. Same thing applies here, he stole to make a high way better, he didnt steal for personal benefit.

I heard an interview with this guy on NPR. First off, I was kind of surprised by his when I saw what he looks like. But anyway, he was talking about how the company that produces those barrels not only doesn't want charges pressed, they want the police to hand over the sculpture so they can use it for advertising purposes.
Everyone thinks it's awesome except for the people who benefit from it being illegal.
Public space belongs to the public. Or at least it should.
