I think what Ellison was asking was: "Was there waterboarding/torture done?" Why couldn't he just say so? And how could Yoo answer that? He didn't know - or couldn't say he knew (classified information).

  • The committee wanted certain answers so that those answers would back up their condemnation of the previous administration. They realized they were probably not going to get those answers (the truth would reveal they were wrong and malicious in bringing this to the stage it was now at) and they became angry because they were going to get exposed. So they tried to set this man up. It is apparent in his demeanor that he did not want to offend them but they were insisting he was offending them!!!

  • @RavingDissension I havent read any of his writings but from what I can meagerly interpret (i am not a law student) is that he gave a disingenuous reading of law regarding the use of presidential authority and torture. that disingenuous reading was then bolstered by the simultaneously negligent and proactive (or at least proactively negligent) attitudes of the Bush administration surrounding these issues. These attitudes then allowed for atrocities to occur.

Writers such as Harold Koh often confused what's legal with kindness, compassion, etc and end up REQUIRING kindness as part of our legal obligation. Yoo should be understood in the context of his defining what's legal.

    Congressmen are not infallible, what they were asking Dr. Yoo to speculate on is illegal. It's a good thing he didn't fall for it.

  • Specifically, Dr. Yoo never said that it was ok to crush anyone's child's testicles. When that absurd question was raised, he responded that there was no treaty which prohibited it. That is true.

    I don't know which part of the constitution you are referring to. Perhaps it would be best if you cited it, if you can find it.

    No one ever said torture wasn't horrific, Yoo hasn't commanded anyone to torture. He has shown the legality of the president to use whatever means he deems necessary in war.

    overall, I'm pretty sure he's dicking him around. Given the succinctness of everyone else speaking there and asking simple questions, his blundering and passive aggressive demeanor here shows he clearly has no intention of giving him a straight answer, and he used the vauge idea of a "detailed answer" to claim he had privilege to not answer. Also you can hear the whispers of his ghost lawyer in the background if you bump your volume.
