  • With all the edit cuts in this clip it's hard to know what the testimony really amounted to. Did they manipulate anything, or were they using the standard as it existed at the time of the study? It's always easy to claim that the other guy 'manipulated', and you only 'interpreted'.

  • Jordean1,

I posted this deposition. To the extent you are concerned that it may be edited such that it does not accurately reflect the actual testimony, I am happy to email you the entire transcript so you can judge for yourself. Simply post your email and I will forward, free of charge to anyone asks.

  • greg5566: it's fairly common to take a videotaped deposition and stipulate that it can be used at trial instead of having the expert actually attend trial.

  • I don't understand--why did the lawyer say "are you telling the ladies and gentlemen of the jury"--isn't this a deposition?

  • Because it will be played for the judge and jury

  • How do you know that? Why isn't he testifying in court?

  • Oh, never mind, I see that right above this comment someone said it is common for the parties to stipulate that the videotaped deposition can be used at trial. I've never heard of that before, but it answers my question.
