Before the Constitution the closest reference to Natural Born Citizen is the legal treatise “the Law of Nations,” written by Emerich de Vattel in 1758. Book I, Chapter 19,
§ 212. Of the citizens and natives.
“The citizens are the members of the civil society; bound to this society by certain duties, and subject to its authority, they equally participate in its advantages. The natives, or natural-born citizens, are those born in the country, of parents who are citizens." (cont.)

In 1784, Alexander Hamilton arguing for the defense in the case of Rutgers v. Waddington extensively used Vattel, quoting from the Law of Nations. Samuel Adams in 1772 wrote, “Vattel tells us plainly and without hesitation, that `the supreme legislative cannot change the constitution” Of course they referenced the Law of Nations when they penned the Constitution.

Vattel wrote in French. He never used the phrase "natural born citizen". That phrase did not appear in an English translation of his work until 1797, which was a decade after the Constitution was written.

2nd sentence- "Les Naturels ou indigènes sont ceux qui font nés dans le pays de Parens Citoyens.".
You're right the phrase "natural born citizen" didn't show up in the English translation until 1797. That wouldn't change the meaning in French. Remember, ppl like Benjamin Franklin & Thomas Jefferson knew French and didn't need the translation.

Indigenous means native. My point was, even if the Founders were fluent in French, the phrase "natural born citizen" was not in Vattels work, so therefore, the Founders did not get the definition from de Vattel.

In the original French Text, there is nothing that comes close to 'natural born citizen' when translated into English. It wasn't until an English translation by a publisher in New York in 1797 that the phrase 'natural born citizen' was placed into 'TLON". Nearly a decade after the Constitution was written. So, you lose.

In fact, the framers rejected the notion that the United States was under English Common Law, “The common law of England is not the common law of these States.” George Mason one of Virginia’s delegates to the Constitutional Convention.

You are right we reject the common law of England but Emer (Emerich or Emmerich) de Vattel (25 April 1714 – 28 December 1767) was a Swiss philosopher, diplomat, & legal expert whose theories laid the foundation of modern international law and political philosophy. We get the definition of Natural Born Citizen from his work in french

Since he never used the phrase 'natural born citizen' in his work, yet the Founders put that precise phrase in the Constitution, any claim of a direct connection is just an assumption. We know from Franklin's writings that those at the Constitutional Convention had access to 'TLON", but beyond that, anything else is just supposition. Which would not hold up in court. Thus, there is no legal definition of NBC as written in the Constitution.

Of these 44 presidents, 34 were born after 1787 (the year the Constitution was adopted) and were therefore subject to the "natural born citizen" requirement. (cont.)

Epic failure on your part. In fact, the first few times that 'TLON" was translated into English, it did not contain the phrase 'NBC'. It wasn't until the 1797 translation that the phrase was put into the book. You lose again.

In Minor v. Happersett (1874), the Supreme Court used the term "natural born citizen" only in reference to persons who were born in the United States, of U.S.-citizen parents. The Court expressed doubts concerning the citizenship of persons who are U.S.-born of non-citizen parents, but regardless of whether such persons were or were not citizens, they were (in either case) not natural born citizens

In Minor, it states that the children of citizen parents born in the US are 'without a doubt' Natural Born, but that they are not the only ones. Also, in the prevailing opinion, the Chief Justice writes that this case would not try to define who is or is not a natural born citizen. Minor not only does not define NBC the way you want it to, but goes out of its way to avoid defining it at all. Again, you fail.

The 'doubts' referred to there are those concerning whether other classes of citizens besides those born on US soil to 2 citizen parents were Natural Born Citizens. The justices on Minor avoid defining NBC, thus leaving open to question who else may be NBCs. Try to do your homework next time. It is almost too easy slapping down you Birthers.
