I would find such a stop reassuring that my tax dollars are being spent in part on securing the nation. Or again, we can continue to be invaded and moving toward a largely illegal work force.

    Doesn't matter what time of day or night it is regarding traveling along a public highway. Agents need reasonable suspicion to initiate a traffic stop. If the agent had reasonable suspicion here, he wouldn't have turned around & walked away when confronted.

  • The only interfering & evading going on here bernielhat was from a Border Patrol agent who interfered with my travels absent reasonable suspicion & then evaded justifying his actions when confronted. In fact, he evaded so much he practically ran back to his patrol vehicle to get away.

    BTW, no one should cooperate with enforcement agents who illegally shotgun traffic & seek to violate the very rights their sworn to protect.

  • @CheckpointUSA Not really. It may be because I have a biased view towards law enforcement. I have been around law enforcement for most of my life. A lot of my family members are LEOs. I myself am in the process of becoming a Federal Officer. So, no, i don't see a problem. I always carry my ID that shows I'm an American citizen and obey the law. It seems that your just paranoid and aren't telling the whole story. This reminds me of the people my parents have to deal with, and they are good people

  • If he is a BP agent, he probably had some kind of reasonable suspicion to think you may have breaking the law that is within his scope of authority to enforce. Then upon approach of your vehicle, he realized that you're just a cry-baby caucasian minute-man wanna be and when you started giving him a hard time, he was like "fuck this guy, 10-8"...

    "PEACE OFFICERS" are LAWFUL servants of the common law. Always make sure to ask which you are dealing with.

    This is merely one example of Lawful vs "Legal."

    'Legal' is color of law, but NOT law.. legalities may only carry the "force of law", but are not now, never were or will be the LAW. In fact.. many are frauds.. which is what you expose time and time again in your videos.

I've been pulled over counting 8 times for absolutely no reason and im now sorry i ever handed my drivers license over and engaged in conversation. I still cant believe that people are against what you are doing, living near the border and having dealt with the harassment from the border patrol 60 miles from the border is enough to make a man crazy, its absolutely ridiculous how so called border security is being handled.

  • I don't think border patrol agents are allowed to stop someone for a traffic or vehicle code offense, and unless someone at the agents dispatch screwed up and told him a vehicle matching yours was containing illegals this stop had to have targetted.

    How far away was this from the checkpoint in your other videos, and how far north of the border is this portion of SR86?

  • This stop took place about 2-3 miles from the checkpoint appearing in my other videos Reaganwannabe. This portion of SR86 is about 40 miles North of the border.

  • One of the best ways to "subdue the situation" created by a "law enforcement official" who has overstepped his lawful authority is to demand his name while filming him Cataclysm135. Demanding his name reminds him of who he ultimately answers to while making it clear the easy mark he thought he had may not be so easy after all. Filming him lets him know his words & deeds can be used against him in a court of law if necessary.

  • I am curious why you do not wish to open your window? I fully realize and support your right to refuse to do so, but I would like to know your rationale for disputing that particular request. Specifically, I see it as a way of easing communication between oneself and law enforcement officers, and refusing to do so seems only to result in antagonizing someone who is, truly, only trying to do their job. Absolutely you shouldn't have to answer their questions, but that part just seems petty to me.

  • The last time I gave an officer/agent the benefit of the doubt by rolling down my window & engaging in polite conversation, I was dragged out & maliciously charged with several violations. I defeated those charges in court & launched an ongoing lawsuit that's over 7 years old.

    That's one reason.

  • @Chasmodius The very bottom line here is that exercising ones rights in whatever way antagonizes LEO. They just don't like it or respect you when you exercise your rights. They'd much prefer it if you allowed them to walk all over you. They are our SERVANTS - they are the ones who should be 'yes sir - no sir' but they expect the opposite and when somebody exercises their rights and frustrates them - makes their job more difficult - they assault you and try to make your life hell.

So what you're getting at here is not anti border protection, rather anti BP acting as LEO's? Im just a little confused thats all. Maybe we should use NG troops for border protection instead of 83 series LE, might take away some of the confusion. Just a thought.

  • I think the confusion comes from Border Patrol agents not actually patrolling the border or its functional equivalent but instead harassing domestic traffic inside the country absent reasonable suspicion or probable cause goarmymp.

    If this agent had reasonable suspicion, he wouldn't have turned around & left like he did. His actions undermine the rule of law and the safety/security/liberty of the traveling public.

  • @YamsRyu You should pay closer attention. I didn't cut any video. I muted the audio in one section because my personal information was being broadcast over the agent's radio.

    Additionally, it wasn't a cop who stopped me. It was a federal Border Patrol agent who only has authority to initiate a traffic stop if he has reasonable suspicion to believe the vehicle contains illegal aliens.

    If he had such a belief, it wouldn't have mattered who I was & he wouldn't have just walked away.

  • @CheckpointUSA any LEO making a traffic stop has the right to demand Name, DOB and address. Just ask the supreme court. Does not matter what the stop was for. It's called checking for warrants.

    "Border Patrol agents have no part in enforcing laws that regulate highway use, and their activities have nothing to do with an inquiry whether motorists and their vehicles are entitled, by virtue of compliance with laws governing highway usage, to be upon the public highways. - U.S. V Brignoni-Ponce

    BP agents have very limited powers centered around immigration. Inside the country they cannot compel the production of an ID.

  • Additionally, SCOTUS has said the following regarding BP roving patrol stops goarmymp:

    "...an officer, whose observations lead him reasonably to suspect that a particular vehicle may contain aliens who are illegally in the country, may stop the car briefly, question the driver & passengers about their citizenship & immigration status, & ask them to explain suspicious circumstances; but any further detention or search must be based on consent or probable cause. - U.S. v Brignoni-Ponce

  • Finally, even for regular law enforcement officers, an officer must have reasonable suspicion to initiate a roving patrol traffic stop goarmymp. In the absence of reasonable suspicion, a roving patrol stop is illegal.

    Even at checkpoints, a warrants check represents a general law enforcement concern. SCOTUS has ruled general law enforcement checkpoints to be illegal in Indianapolis v Edmond.

    You'd think an MP who also serves as a sheriff's deputy would have a better grasp on the law...

  • Never have a challenging attitude when an Officer approaches your vehicle. He may have been stopping you to let you know you had a tire going flat. Take it easy! Things would have gotten ugly between us simply because you felt the need to over react. your lucky the Agent didnt take your actions as a sign of hostility and fear. I would have investigated further to find out why you were acting this way. I can see already that you would have most likely got to "ride the lightning".

  • So you wouldn't feel bad if an office pulled you over to notify you that you had a flat tire or a tail light busted out? What if your vehicle matched the profile of a serial killer or a kidnapper's vehicle? Would you still feel hostile towards them if they're trying to find a bad guy?

They're about suspicionless immigration checkpoints and roving patrol stops by federal Border Patrol agents who have far more limited authority with regards to when they can initiate a traffic stop and what they can do during one.

What would he "ride the lightning" for? Not liking you? Also, I'm not sure what level of education law enforcement are required to possess, but "you are" is abbreviated as "you're", not "your". We typically learn the difference in 5th grade. Dumbass.

  • @ugascam I'm not sure what video you watched but in the one I posted, the agent had no reasonable suspicion to believe I was in the country illegally. According to U.S. V Brignoni-Ponce, reasonable suspicion is the minimum level required to initiate a roving patrol stop.

    If less people weren't as afraid as you to exercise their rights, we wouldn't have so many abuses by government agents.

  • Cops get mad when WE record them. They should be happy. Pretty soon. More people will stop recording and start making cops dissappear. It happened here in los angeles, CA where one cop got shot in front of his wife and kid. Soon every cop will be hunted for their corrupt acts. Its only a matter of time. I would much rather win in court. But others are getting tired of wasting time.

    I didn't stop & seize a Border Patrol agent absent suspicion along a public highway in the middle of the night absent suspicion along a curvy highway with no lights and no developed shoulders. The Border Patrol did that to me which means they weren't doing their job, they were abusing their authority.

    First off, Checkpoint is a PRIVATE US citizen, therefore he doesn't have to list his name or information to you, in fact it is best he doesn't.

    The BP agent is a PUBLIC Official, meaning his name and identification are public record and therefore every US citizen has the right to know that info.

  • Oh really? Why don't you reference the statute that states BP agents are authorized to stop a vehicle inside the country away from the border absent reasonable suspicion or probable cause to believe the vehicle is carrying illegal aliens. Then reconcile it with the BOR.

    I've already referenced these agent's field manual and several court cases that say otherwise.

    BTW, we live in a Constitutional Republic, not a democracy which means voting has nothing to do with maintaining individual rights.

Nobody watching this can say what radio communicaions the agent had with his dispatch that may have led to this traffic stiop except for the agent hmself.

  • Acting under homeland security laws BP agents do not need a reason to stop vehicles, provided that stop is to check for illegal aliens. ;) Check up on your laws.

    "INS officers on roving patrol may stop a vehicle only if aware of specific articulable facts, together with rational inferences from those facts, that reasonably warrant suspicion (reasonable suspicion) that the vehicle contains illegal aliens. Absent consent, a more in-depth search requires probable cause for both types of inland traffic-checking operations."

    The agent didn't drag me out of my car because he knew that he violated the law by pulling me over without reasonable suspicion. Upon seeing my video camera and hearing my name, he realized I knew it too and decided upon the better part of valor.

    Any other action on his part would have made things much worse for him in the long run than it would have been for me in the short term.

Also how do you know that they have nothing one you? they maybe stopping you because your vehicle matches a description of a BOLO they got earlier. There maybe a number of things that you're not aware of that give them RS to stop you and if you run you're just screwing yourself over even more.

  • I do work in law enforcement, and I am not a paranoid person. So a little bias to the "man" may cloud my judgment. But I do not expect anyone to lick anything. In order for our society to remain free of terrorism and illegal aliens, we should tolerate a little intrusion.

  • Absent individualized probable cause, the appropriate place to guard against illegal aliens and terrorists entering the country is the border where there's no question as to who is entering illegally and who isn't. Not public highways well away from the border and never intersect the border at any point.
