Actually Frank Epperson sought a patent in 1924, for his product "Epsicle" (later changed name to Popsicle). He called it a "frozen confectionery" .. So John was wrong there about it not being a confectionery.
FYI: Frank Epperson invented the Popsicle in 1905 at the age of 11 when he accidently left a cup of powdered soda, water and a stirring stick outside in freezing weather. He would make his Epsicles for his family and eventually his kids who called them Pop's Sicle and eventually he went public in 1923.

@Kate8790 yes he did but he's was only joking and saying it loud enough for the panel and audience to hear and then starting the conference.
